    This Act amends the Planning and Development Regulations 2001, as amended, by inserting a new Chapter 3A into Part 4 prescribing matters relating to applications to planning authorities under section 42(1A) of the Planning and Development Act 2000, as amended, for a further extension of the duration of planning permissions for certain developments of 20 houses or more. The Regulations also make consequential amendments to Chapter 3 of Part 4 of the 2001 Regulations.

    The Regulations make amendments to the Landfill Tax Regulations 1996 in order to make changes to the operation of the Landfill Communities Fund (the ‘LCF’). These Regulations, first, reduce the maximum amount of credit that a registered person may receive in respect of LCF contributions in any contribution year. Secondly, the Regulations prevent registered persons making payments to approved bodies on condition that the sums paid may only be invested in order to generate interest.

    The Minister validates the methods of land rehabilitation of landscapes damaged as a result of subsoil management due to mining and extraction of minerals. It shall not be applicable to deep quarries subject to issuance of special permits for operation thereof. Land rehabilitation procedure must be performed by land owners and land tenants that have extracted common minerals on surface or near surface for their own individual needs.
