This country profile has been compiled as part of a series of country factsheets particularly prepared for Dutch embassies that are developing a strategic analysis on food security and water. The factsheets present the relevant policy and institutional contexts with respect to land governance for each of the 15 selected countries. They have been updated in July 2012.
This Act establishes the Land Surveyors Board, provides for the licensing of land surveyors and disciplinary proceedings against land surveyors, defines the duties of land surveyors and provides rules for the carrying out of original surveys, re-surveys and division surveys of land and related matters.The Land Surveyors Board shall, among other things, keep a register of licensed surveyors and act as arbitrator in any dispute between a licensed surveyor and a client. Surveyors shall be licensed by a Licensing Authority as defined by this Act.
This Act makes provision with respect to small holdings i.e. any land or parcel of land with or without a dwelling house or other building erected or to be erected thereon not exceeding in all five acres in area let for agricultural purposes and of a specified maximum total value. The Act specifies the (contractual) rights of a tenant of a small holding including the use and enjoyment of all ground crops, plants, fruit trees or other trees. The Act also specifies rights of the landlord and provides with the resolution of disputes between the parties to any contract under this Act.
The LAPSSET Corridor project, a major infrastructure development project that will run from Kenya to South Sudan and Ethiopia, will impact, positively or negatively, on the lives of more than 100 million people in the three countries. Indigenous peoples will potentially suffer the most negative impacts as a result of their having been historically marginalized economically, socially and politically. The recent discovery of oil in Turkana will add to the suffering of the Turkana peoples.
In land administration (LA), the right to exercising property/ownership rights on land is based on cadastral processes of adjudication, survey and rights registration. This Act makes provision for the resolution of disputes by arbitration. The authority of an arbitrator or umpire appointed by or by virtue of an arbitration agreement shall, unless a contrary intention is expressed in the agreement, be irrevocable except by leave of the Court. “Arbitration agreement” means a written agreement to submit present or future differences to arbitration.
This Act establishes the Land Administration Authority as a body corporate and provides with respect to its functions and powers and its administration and management. The Authority shall be an agency of the Government of Lesotho responsible for land administration and shall operate under the general supervision of the Minister responsible for land matters.

This Act, among other things, vests the property of mineral rights in the President, provides with respect to the administration of matters regarding mines and minerals, provides for the granting of mineral rights and related matters, and provides for the protection of the environment in relation with mining operations. The Act also includes provisions concerning dispute resoluation.No person shall carry on in Malawi reconnaissance, prospecting or mining operations, except under and in accordance with a Mineral Right, a non-exclusive prospecting licence, a claim or a mineral permit.
This Act amends the Affidavits of Prescription Act by providing for the suspension of sections 3, 4 and 6 to 9 of, and the Schedules to, the principal Act and provides for the circumstance where notice of an application has been published in accordance with section 4(2) of the principal Act and an objection may be made in the manner specified in section 6(1).
