    This Scheme makes provision for the making of grants in respect of agricultural businesses which are at least partly situated in nitrate vulnerable zones, as defined by regulation 3(1) of the Protection of Water against Agricultural Nitrate Pollution (England and Wales) Regulations 1996 and regulation 3(1) of the Nitrate Vulnerable Zones (Additional Designations) (England) (No. 2) Regulations 2002. The grant is available in relation to facilities for the handling, storage and disposal of certain farm wastes and the separation of clean and dirty water.

    These Regulations implement in relation to planning in Northern Ireland, Article 12 of Directive 96/82/EC on the control of major accident hazards involving dangerous substances. They amend the Planning (Development Plans) Regulations (Northern Ireland) 1991 to add to the matters that the Department shall have regard when formulating its development plan policies and the Planning (Hazardous Substances) Regulations (Northern Ireland) 1993 by substituting a new Schedule 3 prescribing the substances which are hazardous substances and their controlled quantities.

    These Regulations prescribe the processes the carrying on of which after a prescribed date require an authorisation under Article 6 of the Industrial Pollution Control (Northern Ireland) Order 1997. They designate the description of each process as one for integrated central control (Part A processes), restricted central control (Part B processes), or local control (Part C processes) (Regulation 5).

    These Regulations amend the Town and Country Planning (Hazardous Substances) (Scotland) Regulations 1993. They confer transitional immunity from prosecution and contravention proceedings for a period of six months from the day these Regulations came into force and correct an error in Schedule as substituted by the Planning (Control of Major-Accident Hazards) (Scotland) Regulations 2009.

    This Act converts ultra-long leases (i.e. leases that were let for over 175 years and that have over 100 years left to run from the appointed day) into ownership. Certain leasehold conditions to real burdens. The Act also covers compensation for loss of landlord’s rights and provides exemption from conversion and continuing leases. The conversion of qualifying leases to ownership is automatic, unless the tenant chooses to opt. The Act extinguishes all rights and obligations arising from the qualifying lease and any superior lease.

    These Regulations make provision in connection with the preparation and content of schemes of delegation and the procedure for reviews under section 43A of the Town and Country Planning (Scotland) Act 1997. Section 43A requires a planning authority to prepare a scheme of delegation by which applications for planning permission and for consent, agreement or approval required by a condition imposed on a grant of planning permission are to be determined by an appointed person.

    These Regulations make provision regarding the making of tree preservation orders under section 160 of the Town and Country Planning (Scotland) Act 1997 and disapplies section 172 of the Act, which protects trees in conservation areas, in respect of various acts. The Regulations also prescribe how an application for consent to carry out any action prohibited by a tree preservation order is to be made.
