These intricate and sensitive issues, manifested in ethnic conflict, violent cattle raids, and government evictions characterised by human rights abuses have displaced people throughout the country.

    The practice of forced eviction is a global phenomenon. Between 1995 and 2005, a survey covering only ten countries, showed that over ten million people were forcibly evicted. These people were left homeless and subject to deeper poverty, discrimination and social exclusion. A number of such evictions involve entire communities of tens or even hundreds of thousands of people. Such communities are invariably evicted against their will and in most cases without any compensation or alternative housing.

    Until recently, the legal framework on land was marred by the existence of multiple land laws, some of which were incompatible. These laws, coupled with the rampant land injustices hampered efficacy in land ownership, management and administration of land. As a result, the Constitution of Kenya (CoK) has changed the laws on land and the dispute resolution institutions.

    Because of changes in some underlying factors, land is increasingly becoming a source of conflicts in Africa. We estimate the determinants of land conflicts and their impacts on input application in Kenya by using a recent survey of 899 rural households. We find that widows are about 13 percent more likely to experience pending land conflicts when their parcels are registered under the names of their deceased husbands than when titles are registered under their names.

Unfortunately, effective land registry and cadastral systems with national coverage exist in only a fraction of the world’s countries. Cadasta Foundation is working to overcome this challenge by developing simple digital tools and technology to help partners efficiently document, analyze, store, and share critical land and resource rights information.

    This working paper reviews historical and current factors and patterns affecting land use, land tenure, resource access, human settlement, and conflicts over resource access and tenure in the districts around Mt. Elgon in Kenya and Uganda.     This paper employs an historical analysis to consider some of the consequences of conflicting resource use and political friction on resource exploitation within and outside Turkana District during this century. Given this historical context, development alternatives tested to ameliorate food insecurity are reviewed.The article proposes that the stage for political conflicts, environmental degradation and food insecurity within the region was set decades ago.
