In compliance with the principles and rules laid down in Directive 96/61/EC, this Regional Act makes provision on integrated pollution prevention and control, with a view to securing a high level of protection of human health and the environment. In particular, the Act lays down rules governing the issue and renewal of the integrated environmental authorization of existing and new installations (those mentioned in Annex I to Directive 96/61/EC).

In implementation of articles 17, 19 and 21 of Legislative Decree No. 22 of 1997, the present Regional Act lays down rules governing the environmental restoration of areas which have been polluted by waste. Furthermore, it makes provision on the elaboration of the Land Reclamation Plan (art. 3). Article 2 provides for the creation of the register of areas to be restored.

The Autonomous Provinces of Trento and Bolzano are hereby empowered to exercise functions in matter of small cultivated areas, hunting, fisheries, apiculture, forestry and wildlife protection. The latter shall be regulated by Provincial Acts defining the hunting calendar and specifying the species which may be hunted. With a view to contributing to the improvement and development of mountain areas, article 7 makes provision on the setting up of Mountain Communities.

The present Regional Act lays down the legislative framework in matter of town and country planning. The regional territory shall be managed through plans adopted and implemented at the municipal, provincial and regional levels, pursuant to the principles of coordination and subsidiarity (art. 3). Title II (arts. 12-30) defines with detail the above-mentioned plans. Title V (arts. 43-45) is entirely devoted to the protection of agricultural lands and building in such lands.

The present Regional Act lays down the framework relative to the expropriation for public purposes of land. Article 4 provides for the setting up of a Commission which shall be responsible for the application of the expropriation procedure. Detailed provisions concerning the compensation to be paid to owners are laid down.

Particular amendments are hereby laid down to Regional Act No. 42 on forestry, with regard to the approval procedure for the programme on forestry and the implementation of projects. Article 11 on the fire-fighting service is replaced by the text laid down in article 5 hereto.

In view of the fact that a good knowledge of the biochemical characteristics of soil is necessary in order to arrange and implement a sound national policy for programming the use of soil and waste water for irrigation purposes, this Decree approves the official methods to be applied in the biochemical analysis of soil.

In implementation of Act No. 257 of 1992, the present Regional Act lays down provisions intended to ensure the protection of public health against pollution caused by asbestos. The Act establishes preventive measures to be applied when decontamination interventions are carried out. Article 3 regards the Regional Plan on Asbestos to be adopted by the Lombardia Region. Further, article 5 concerns the registers and the information to be kept by each competent local health authority as regards those sites where asbestos exists.
