This Regional Law regulates some issues related to turnover of land parcels and land shares in common property concerning agricultural land. Maximum land area of agricultural land that can be allotted to a single natural of legal person on the territory of a municipal district shall be 10 percent of the total available agricultural land. Minimum land area of agricultural land allotted to production of agricultural commodities shall be 70 ha.

This Regional law establishes that minimum land parcels of public and municipal land that can be allotted to citizens for gardening and horticulture shall be 0,03 ha, while maximum land parcels of public and municipal land that can be allotted to citizens for gardening shall be 0,15 ha and for horticulture 0,25 ha.

This Regional Law regulates relations related to tenure, ownership and management of agricultural land. It establishes minimum agricultural land area in the process of land consolidation of 0,04 ha. Maximum agricultural land area owned by a single natural or legal person shall not exceed 10 percent of total available agricultural land area. Regional administration shall have preferential terms for purchase of agricultural land at established price. Minimum period of lease of agricultural land for agricultural production shall be 11 months, for other authorized uses – 10 months.

This Regional Law regulates the issues of transfer of land from one category to another. Transfer of land, except for agricultural land, pertaining to private or municipal ownership, shall be performed by local government. Transfer of agricultural land pertaining to private or municipal ownership shall be performed by the Regional Government. Transfer of urban land to any other land category shall be performed by the Regional Government.

This Regional Law establishes legal grounds of the relations between landowners, landlords, land tenants (including foreign natural and legal persons land lease holders) and state bodies in the sphere of ensuring soil fertility of agricultural land, and also establishes rights and duties of natural and legal persons performing agricultural production in relation to efficient use of soil fertility. Soil fertility of all types of agricultural land must ensure sufficient conditions for crop growing without oppression of soil organisms.

This Regional Law shall be aimed at the development of land relations and improvement of the mechanism of state regulation of payment of land charges. It establishes that the amount of payment for agricultural land allotted to agricultural enterprises, peasant farms, cooperatives and subsistence farms for agricultural production shall not exceed the amount of taxes applicable to land parcels allotted on lease.

This Regional Law regulates relations concerning attribution to local government plenary powers related to management of public land pertaining to re-distribution land stock. In particular it envisages the modalities of auction sale of the right of lease of public land and conclusion of lease contracts. It regards transactions with agricultural land.

This Regional Law regulates transfer of land from one category to another, or classification of land plots by categories, including classification as agricultural land, municipal land or private land ownership. Request for transfer of land plot from one category to another must contain the following data: (a) land area; (b) cadastre number of land plot; (c) location of land plot; (d) actual land category and destination category; (e) substantiation of transfer request; and (f) land rights.

Estas disposiciones introducen algunas modificaciones a la Ley Nº 113 sobre el régimen de colonización y las tierras fiscales. Las enmiendas tienen por objeto la inembargabilidad e insusceptibilidad de venta judicial de las tierras fiscales afectadas por el Poder Ejecutivo a planes de colonización, obras públicas, desarrollo rural, actividad económica estatal, urbanización o construcción de viviendas y otros fines de perfeccionamiento social, las mejoras enclavadas en éstas y los derechos y acciones que existan o pudieran existir sobre las mismas.

Mediante esta Ley se crea el Fondo para el Desarrollo Agropecuario, cuyas finalidades serán la de promover y ejecutar acciones que dinamicen la actividad privada en el sector agropecuario favoreciendo el aumento de la productividad, el aseguramiento de la sustentabilidad y la valorización de sus productos, garantizando el acceso equilibrado de todos los actores del sector a los recursos, servicios y oportunidades generadas.

This Law regulates relations regarding licensing of some activities. It shall not be applicable to the issuance of licences related to licensing agreement between natural and legal persons. The Act consists of seven Chapters divided into 52 Articles: (1) general provisions; (2) the state licensing system; (3) types of activity; (4) licensing of import and export; (5) licensing terms and conditions; (6) renewal, cancellation and suspension of licences; and (7) final provisions. Licensing terms and conditions shall be equal for all persons complying with the established requirements.

La presente Ley modifica e incorpora nuevas disposiciones a la Ley Nº 1.715 de 1996, con la que se estableció la estructura del Servicio Nacional de Reforma Agraria, abocado a realizar la reforma agraria y el régimen de distribución de tierras. Entre las nuevas disposiciones cabe destacar los párrafos del III al IX (incorporados al artículo 2º) que se refieren a la función económico-social de las tierras y áreas agrícolas.
