This Act regulates the underwriting of land in relation with the settlement of debts. Article 4 defines the rights on land that may be underwritten. Article 5 provides for priority of underwriting rights, the right follows the object of underwriting. Articles 10 to 19 provide for procedures of establishment, registration, transfer and abolishment of underwriting rights.

This Act amends Sections 16 and 17 regarding, respectively, rights and facts to be recorded in the real estate register. Section 26 of the Basic Text on the commencement of registration proceedings is also amended. Section 32 of the Basic text regarding the contents of documents valid for the purpose of real estate registration is replaced.

This amendment increases the maximum allowable nominal value of land bonds that may be issued under section 5 of the principal Act and that may be outstanding at any one time, from $ 80,000,000 to $100,000,000 or such greater amount as the House of Representatives may from time to time, by resolution, approve.

This Act makes provision for the use and development of land. The Land Development and Utilization Commission, established under section 12, may with the approval of the Minister, from time to time, by order designate as agricultural land any land, which the Commission considers ought to be brought into use for agriculture.

The present law determines the legal, economical, organizational and social principles as well as the basic terms of the privatisation of State property of Georgia and provides for the purchase of property owned by the State by physical or legal persons or their unions. The objective of this Law is to establish promote ownership and a market economy.

The State registration of rights to land shall form an integrated part of the land cadaster. Registration shall be carried nation-wide by the State Land Management Department and be managed by a Chief Registrar. A Zone Registrar shall manage registration in a specified zone. Powers of a Registrar are set out in article 7.
