The Act lays down rules concerning rental of land and enterprises for agricultural production, as well as provisions on rental of forest lands. Contractors must be included in official registers.

The Act is composed of two main parts. The first part establishes: conditions of the application of sewage sludge and bottom sediments into the agricultural land and into the forest land so that their hazardous impact on the properties of soil, plants, water and human and animal health is excluded; obligations of producers and receivers of sewage sludge and bottom sediments; activities of state control concerning the application of sewage sludge and bottom sediments into the agricultural land and on the forest land; sanctions for violating provisions established by this Act.

This Act concerns pounds and the construction of fences for the protection of the ground within its bounds from animals, including horse, cattle, swine and geese. Under section 4, when an animal trespasses any lawful fence, the owner of the land shall return the animal to the nearest pound keeper or district and the owner of the animal is responsible for damages caused to the land or the fence. Under section 6, the owner or occupier of land where an animal is kept, or the person in charge of the animal, is liable for any damage done by the animal as if the animal were of their property.

El presente Decreto reforma el párrafo segundo del artículo 15 de la Ley de Reforma Agraria estableciendo que el Instituto Nacional Agrario (INA) exigirá la inmediata devolución de todas las tierras nacionales y ejidales que estén ilegalmente en poder de particulares, a excepción de quien acredite la ocupación de tierras inferiores a 200 hectáreas y su explotación en sistemas agroforestales o silvopastorales, cultivos intensos o crianza de animales en confinamiento.

Agricultural Leases (Reletting) Act.

This Act establishes rules governing the reletting of agricultural land. Where a lessor desires to make any change in the conditions of a lease on the expiration of its term, unless an agreement is reached with the tenant, he shall apply to the Rural Leases Control Board (which is established under article 5) and indicate the proposed changes. The Board may reject, approve or modify the new conditions proposed by the lessor. Article 4 regards the non-renewal of lease.

Land Improvement Act.

This Act provides the requirements for the designing, building and management of land improvement systems, the specifications for the foundation and operations of land improvement associations operating as non-profit associations, the procedure for exercising state supervision over implementation of this Act, and liability for violations of this Act. A regulation network shall ensure that the soil water regime is suitable for crop husbandry and shall minimize the threat of the spread of pollution.

La presente Ley establece el marco normativo para promover el cumplimiento de la función social de la tierra fiscal, mediante su arrendamiento y enajenación en forma progresiva y orgánica a favor de los auténticos trabajadores del campo. El objetivo principal de la Ley es la protección del campesinado y la reactivación de la tierra fiscal. En este contexto se fija el principio en virtud del cual la tierra no debe constituir un bien de renta sino un instrumento de trabajo.

This Regional Law establishes rates of land allotment to citizens into ownership for agricultural purposes and maximum land areas to be allotted thereto. Maximum land areas shall be established as follows: (a) for gardening – 0,50 ha; (b) for horticulture and vegetable growing – 1,00 ha; (c) for stockbreeding – 1,00 ha; (d) for suburban housing construction – 0,25 ha; and (e) for farming – unlimited agricultural land area.

Regional Law No. 691-OD “On functioning of land reclamation complex”.

This Regional Law establishes that land reclamation arrangements shall be carried out with a view of raising crop productivity and yield, ensuring stable production of agricultural commodities through conservation of agro-landscapes and raising soil fertility, and also for involvement into agricultural production of low-yielding agricultural land, use of waterbodies for potable water supply, water abstraction for public water supply, fishfarming and other purposes. Planning of land reclamation arrangements shall be carried out by the authorized state body in the sphere of land reclamation.

Regional Law No. 769-OD “On maximum land areas allocated to citizens on condition of ownership”.

This Regional Law envisages allotment of land parcels out of stock of public and municipal land in ownership to citizens either for payment free of charge. It establishes maximum land area allotted to citizens in ownership out of stock of public and municipal land for payment as follows: (a) for farming – 400 ha; (b) for gardening – 0,25 ha; (c) horticulture – 0,15 ha; (d) for stockbreeding – 1,00 ha; and (d) for suburban housing construction – 0,25 ha.

This Regional Law classifies protected categories of citizens that shall have the right to allotment on condition of ownership of public and municipal land free of charge related to urban land for individual housing construction and agricultural land for subsistence farming.
