This Regional Law establishes minimum and maximum land areas of public and municipal land to be allotted to regional residents in ownership for farming, gardening, horticulture, stockbreeding and suburban housing construction. It shall not be applicable to agricultural land and it shall not be applicable to purchase of land in ownership by citizens.

This Regional Law establishes the modalities of allocation of parcels of public land to citizens free of charge for gardening, horticulture and stockbreeding, and establishes minimum and maximum land area of the aforesaid parcels. It establishes that regional resident – natural person that has never had nor has parcel of agricultural land in ownership for subsistence farming, gardening or horticulture, shall be granted the right to receive in ownership a land parcel for each of the aforesaid purposes once-only.

This Regional Law establishes maximum and minimum land area of the plots of public or municipal land allotted to citizens in ownership for farming, gardening, horticulture, stockbreeding, subsidiary smallholding and individual housing construction. Total land area of agricultural land that can be owned or held in tenancy or lease by citizens carrying out subsistence farming and subsidiary smallholding shall not exceed 10 hectares.

This Regional Law establishes the modalities of allotment free of charge of land parcels of public and municipal land. It establishes maximum land area allotted free of charge as follows: (a) for farming in accordance with average regional rate validated by local self-government; and (b) for gardening – 0,1 ha.

This Regional Law establishes minimum and maximum land areas of plots of land that can be allotted to citizens in ownership out of stock of public or municipal land for farming, gardening, horticulture, stockbreeding and suburban housing construction, including allotment of the aforesaid plots of land free of charge in cases envisaged by Land Code. Maximum land area that can be allotted for farming shall not exceed 10 percent of total available agricultural land area within the boundaries of a municipal unit at the moment of allotment.

Regional Law No. VH-I “On subsidiary smallholding”.

The scope of this Regional Law shall be to increase the role of private subsidiary smallholding of citizens in raising production of agricultural commodities and it establishes the forms of state support of subsidiary smallholding. Subsidiary smallholding shall be considered a form of non-enterpreneurial activity for production and processing of agricultural commodities that shall be exclusive property of citizens conducting subsidiary smallholding.

This Act provides rules relative to agriculture in Montserrat. The provisions of this Act shall have effect for the purpose of securing that owners and occupiers of agricultural land fulfil their responsibilities to the community to manage and farm the land so as to prevent erosion and ruination of the soil. The Governor shall appoint an Agricultural Lands Commissioner.
