This Act provides a basis for the procedure of all expropriation of immovable property including "restricted real rights". Expropriation" is defined in section 2 as "the transfer of an immovable without the consent of the owner in the public interest for fair and immediate compensation". The sections of the Act are divided into 9 Chapters: General provisions (1); Preliminary work and resolution for expropriation (2); Expropriation payment (3); Agreement process (4); Valuation process (5); Abandonment of expropriation (6); Transfer of possession and ownership of immovables under expropriation and payment of expropriation payment (7); Return of expropriated immovables (8); Final provisions (9). Section 3 lists all circumstances in which expropriation is permitted. Expropriation applications shall be submitted by local authorities to the Minister of Internal Affairs and contain information as set out in section 11. The "agreement process" concerns the amount of compensation to be paid for the expropriation. Requests for such procedure shall be made to the County Governor.
