The amendments of the present Act concern land survey procedures in accordance with the recently enacted Real Property Formation Act (554/95) for various kinds of water areas to which provisions of the Fisheries Act apply. Borders of fish protection areas shall be established by a certified engineer at the request of Fisheries Area Offices (sect. 45). Section 55 provides for the designation by the Land Survey Office of the part in a water area of members in Fisheries Associations in accordance with section 101 of Act 554 of 1995.

The principal Act provides for the procedures of the application for rights relative to constructions in watercourses or related to watercourses as foreseen in the Water Act (sect. 1). The amendments of the principal Act are made mainly as a consequence of the introduction of the Real Property Formation Act (554/95) which formulates, inter alia, rules relative to land survey and mapping. Section 4 refers to procedures in accordance with section 8(a) of Chapter 21 of the Water Act.

A Surveyor-General for Swaziland shall be appointed by the Minister for Works, Power and Communications, who shall: (a) supervise and control the survey and charting of land; (b) take charge of and preserve all records appertaining to surveys of land; (c) examine all general plans and diagrams of surveys of land before any registration of such land is carried out; (d) define on the diagram of any piece of land the geometrical figure representing any portion of the land; (e) cancel or amend in accordance with any law any general plan or diagram found to be incorrect; (f) prepare, certify and

For the purpose of implementing the Land Survey Act 1961, the Regulation establish in Part III, concerning field work, establishes, inter alia, the procedure, methods of measurement and the limit of allowable difference from the original survey. Part IV regards the placing of beacons, the marking of survey stations, the damage to and removal of trigonometrical stations, reference marks and bench marks, and the placing of reference marks.

La presente Ley, que consta de 9 artículos, tiene por objeto establecer un régimen jurídico especial que permita ejecutar en forma ágil el Programa de Transferencia de Tierras, cuya ejecución se le ha encomendado al Banco de Tierras y al Instituto Salvadoreño de Transformación Agraria. La presente Ley dispone que todo poseedor de inmuebles rústicos calificados dentro del Programa de Transferencia de Tierras que carezca de título de dominio, o que teniéndolo adolezca de defectos para su inscripción, podrá titular siguiendo el procedimiento descrito en el artículo 6º.

Cette ordonnance fixe les modalités d'exécution des mesurages officiels des terres prévus à l'article 9 décret du 22 août 1885. Ces mesurages doivent être mis en oeuvre par des géomètres agréés et assermentés.

Cette ordonnance fixe les divers frais cadastraux, à savoir: les frais de mesurage et de bornage officiel des terres et les frais de consultation, de reproduction et d'extrait de la documentation et des imprimés cadastraux.

This Act deals with the administration and disposal of State lands which are defined as all lands other than forest reserves vested in the State, including all lands which have been escheated to the State or may be acquired by the State. A Director of Surveys and Commissioner of Lands shall be appointed to implement this Act. The Act provides for, inter alia, the sale, lease, etc. of State lands; accounting procedures; surveys; penalties for trespass and other offences; legal and administrative matters relating to the purchase of State lands.

According to the provisions of this Ordinance, whenever any land is sold, leased or alienated by the State the Minister may cause the boundaries of such land to be defined by permanent marks. It shall be the duty of the owner or occupier of any land to keep said marks in good repair. The Government Agent shall, when State landmarks have been replaced or repaired or the boundary line has been defined to his satisfaction, grant a certificate to that effect to the owner or occupier (art. 7).

The Act establishes the procedure to be followed by the competent authorities for the acquisition of land for public purpose. It includes, among other matters: investigations for selecting land to be carried out by a district officer appointed by the Minister; issue of notice of intended acquisition indicating the compensation to be paid for any damage caused during investigations; issue of notice of acquisition of land or servitude for a public purpose.

This Ordinance regulates the alienation of State land. For this purpose, it makes provision for the appointment of a Land Commissioner who shall be responsible for the general supervision and control of all Government Agents and land officers in the administration of State land and in the exercise of the powers conferred upon them by the Ordinance.Chapter IV establishes conditions and principles governing the alienation by permit or grant and the criteria for the calculation of the annual payment.
