Village Fono Act 1990.

This Act regulates the functioning and powers of village assemblies called Village Fono. The Registrar of the Land and Titles Court shall compile and keep up to date a register of Village Fono in which shall be recorded the name of every village in which a Village Fono is functioning. Every Village Fono in the exercise of any power or authority shall exercise the same in accordance with the custom and usage of that village.

This Act provides for matters relating to the right to occupy, use and enjoy land under a freehold title by indigenous people. Any indigenous citizen who is the proprietor of an unconditional head-lease registered under the Land Leases Act may apply to the Minister for the grant of freehold title to the land of which he is proprietor.

La présente loi fixe la procédure de l’immatriculation de la propriété foncière. Cette procédure consiste dans l’établissement et l’enregistrement d’un titre de propriété appelé titre foncier. Par ailleurs, en ce qui concerne toute terre non immatriculée (vacante et sans maître, à moins que ne soit rapportée la preuve du contraire), elle prévoit la constatation et régime des droits coutumiers par une commission dont la composition est fixée par décret.

Customary Land Tribunal Act (Cap. 271)

The object of this Act is to provide for a system based on custom to resolve disputes about customary land. This Act provides for the establishment of land tribunals to resolve disputes about customary land and prescribes the procedures to be followed by those land tribunals in resolving such disputes and rules of appeal for parties who are dissatisfied with decisions of land tribunals. Part 2 sets out how a village land tribunal is to resolve a customary land dispute. A village land tribunal can be a single or joint village land tribunal depending on where the land in dispute is situated.

Plant quarantine fees payable in respect of plant quarantine and phytosanitary services as set out under Column I in Part A shall be at the rates specified against such service under Column II in Part A of the Schedule. Animals and animal products fees payable in respect of the services set out under Column I in Part B shall be at the rates specified against such service under Column II in Part B of the Schedule.

At the end of section 26 a provision is added regarding the consent of a Land Board to transfer of rights in land. Such consent is not required in the case of sale in execution to a citizen of Botswana. Section 28 is here renewed. That section concerns the cancellation of grant and recovery of possession by the Land Board in the case of breach of development covenant or unauthorised change of user. The Second Schedule contains the description of an area prescribed as tribal area in the sense of section 2 of the principal Act.

The Measures are formulated in accordance with the 9th article of the Land Law of Tai Wan, are divided into V Parts: General Provisions (I); Cadastre (II); the Land–use Right (III); Land Tax (IV); and Expropriation (V). The Measures provide for the systematic surveying of the land, the criteria of the land tax and the procedures for the expropriation of the land.
