    This Ministerial Decree establishes the modalities of compensation of losses of agricultural production due to expropriation of agricultural land for purpose not connected with agriculture and forestry offsetting investments, made by legal or natural persons to whom was re-allotted expropriated land, for land reclamation in case of damages to fertile layer of soil. Amount of compensation shall be established shall be calculated as the difference between the cost of losses and the cost of investment for land reclamation.

    This Ministerial Decree sets forth the modalities for the accurate determination and mapping of coastlines. The crossline between the surface of surface waterbodies (seas, lakes, rivers, ponds and water reservoirs) and the surface of dry land over a specified period of time shall delineate the coastline. Coastline of seas, lakes, rivers and water reservoirs can be permanent and steady; and impermanent and unsteady (average multiyear level). The coastline of the Caspian Sea shall be determined according to its average multiyear level.

    This Decree establishes that payment for long-term lease of agricultural land plots allotted to an agricultural cooperative (shirkat) shall be collected in the form of unified land tax in accordance with rates and within timeframe established by the acting legislation.     This Provisional Instruction establishes administrative liability for the infringement of land legislation (legislative provisions related to land tenure, land survey and land cadastre). It shall be applicable to all natural and legal persons, including businesses with foreign investments, which are owners, tenants or leaseholders of plots of land. Administrative liability shall be applicable within two months from the date of commission of the offence and, in case of persistent violations within two months from the date of disclosure thereof.

    This Ministerial Decree establishes that transfer of land or protected areas to reserve land category shall be prohibited except for cases of construction of the objects of tourism infrastructure envisaged by State planning documentation, construction of waterworks of strategic importance and construction of facilities along state border. Authorization for transfer of land of protected areas shall be issued only for plots of protected areas with restricted economic activities and shall be applicable in case of impossibility of alternative construction decisions.

    The Premier decrees that beginning from 1 January 2016 allotment of land plots for farming and expropriation thereof shall be performed by decision of local government in accordance with the opinions expressed by territorial councils of farmers and commissions for examination of applications for allotment of land plots for farming.

    This Decree establishes the modalities of compensation of damages to natural and legal persons for expropriation of land plots for state and public needs. Expropriation of land plots shall be performed by local government in case of consent by land owner or by coordination with land tenant or lease holder. In case of lack of the aforesaid consent expropriation can be appealed in court. Decision on land expropriation shall be made in conformity with general land-use planning scheme and in accordance with detailed residential housing construction plan.
