    This Ministerial Decree establishes the modalities of issuance of data on immovable property from the Unified immovable property registration system and, in particular, information on registered ownership right to immovable property, including land plots. The aforesaid information shall be issued for fee. The issued information can be used for attesting one’s right of land shares and agricultural land but cannot be used land transactions. Annexes 1-8 contain the forms of certificates of immovable property, including land plots.

    The Government decrees to validate the Regulation in accordance with Annex 1, to validate compensation norms for agricultural and forestry damages in accordance with Annexes 23 and to establish compensation factor for forestry damages and for land deterioration in accordance with Annex 4. Compensation royalties for agricultural and forestry damages are refunded to the republican budget. Annex 1 contains the Regulation that comprises 3 Sections subdivided in 29 paragraphs.     The Government notes that as a result of realization of the Presidential Decree No. 874 of 1997 on allocation of 25 thousand hectares of lands for personal subsidiary farm of the citizens for increasing production of agricultural commodities there has been achieved real increase in production of grain, potatoes, rice and other agricultural commodities, improved food delivery to the population and the prices for the above-mentioned agricultural commodities have been kept under control. At the same time some mistakes have been committed as regards distribution of land plots.

    This Ministerial Decree establishes the modalities of establishment of water conservation zones and water belts, management of land of water conservation zones and water belts, and also responsibility for keeping thereof. Boundaries of water conservation zones and water belts shall be established with the consideration of physical, geographic, soil, hydrogeological conditions, and purposeful use of waterbodies and also with the consideration of the interests of water users. The aforesaid boundaries shall be mapped.

    This Ministerial Decree establishes that water fund land shall be considered public land occupied by waterbodies (rivers, lakes, water reservoirs, channels, waterworks) and also land along shoreline of waterbodies and water conservation zones. Water fund land shall be used for rational use, conservation and improvement of water resources. Water fund land shall be allotted for open-ended or temporary (for the period from 5 to 10 years) tenancy by decision of local administration or government.

    This Ministerial Decree establishes the modalities for expropriating (redeeming) land to create or enlarge protected areas and for leasing land in protected areas for research, tourism or recreational purposes. Applicants shall submit the technical and financial documentation for the research, tourism or recreational project and a positive expert opinion of the environmental auditor.

    This Ministerial Decree sets forth the modalities for the accurate determination and mapping of coastlines. The crossline between the surface of surface waterbodies (seas, lakes, rivers, ponds and water reservoirs) and the surface of dry land over a specified period of time shall delineate the coastline. Coastline of seas, lakes, rivers and water reservoirs can be permanent and steady; and impermanent and unsteady (average multiyear level). The coastline of the Caspian Sea shall be determined according to its average multiyear level.

    The Government decrees to validate average rates of land tax for provinces, cities, districts and urban settlements that are valid for hayfields, public constructions, forests, areas, channels, irrigations systems and sewerage for non-agricultural purposes, irrigated land, dry-farming land, arable land and perennial plants.

    This Ministerial Decree determines the modalities of transfer of plots of land from one category to another, including conversion of land. Land plots shall be classified into the following categories: (a) agricultural land; (b) urban land; (c) industrial land; (d) protected areas; (e) forest land; (f) water fund land; and (g) reserve land. Each plot of land shall pertain to one of the aforesaid categories.
