    This Law regulates the public relations and legal and organizational issues related to the implementation of the land reform in the Republic of Kyrgyzstan. Land reform is carried out so as to provide for the redistribution of the land in order to create the necessary conditions for equal in rights development of various forms of economy on the land, the formation of versatile economy, for the determination of the rates of the fees for land, and the rational use and protection of the lands at the territory of the Republic of Kyrgyzstan.

    The Cabinet of ministers of the Republic of Kyrgyzstan shall be charged to establish the procedure for restructuring of non-effective kolkhozes, sovkhozes and other agricultural enterprises before August 1, 1991. The local Soviets of peoples' deputies in the course of the land reform shall allocate the land plots from the special land stock into possession of individuals and agricultural cooperatives.     This Law specifies and regulates separately common leases, including lease of land and natural resources, leases of enterprises, and leases by citizens. It provides also for the contract of lease of labor. Article 3 defines the sphere and objects of lease. Article 7 contains rules relative to the lease agreement, and following articles (arts. 8-15) further define the relationship between lesser and lessee, including matters such as fees, protection of the lessee, terms of lease, changes in the agreement, etc.

    This Law to which this Decree refers specifies and regulates separately common leases, including lease of land and natural resources, leases of enterprises, and leases by citizens. Leaseholders having entered into lease agreements before the entry into force of the Law shall have the right to carry on their relationship according to agreement concluded before 1 January, 1991. Various local authorities are charged to render assistance in transforming state enterprises into leased enterprises.

    Land legislation shall be based on the principles set out in article 3. In accordance with the Constitution of the Kyrgyz Republic, land may be the state, communal, private or other forms of ownership (art. 4). Article 4 also defines state lands and communal ownership. Article 5 concerns rights of foreigners to use land. Transactions with rights to a land plot shall be subject to state registration and shall not require notarization, except for the cases provided by law (art. 9). Article 10 defines the Land Fund of the Kyrgyz Republic.

    Dhekan farms are independent commercial enterprises with legal form and capacity as described in article 2. Such farms can voluntarily unite and join cooperative societies. Qualified persons have a preferential right on the granting of land plots. Such land is granted on the basis of conditions specified in article 6. District authorities shall create land funds for purposes of Dhekan development (art. 7). Certificates proving the right on a Dhekan farm are given out by the State. Lease shall be regulated by contract (art. 8). Dhekan farms shall be registered in accordance with article 11.

    This Law makes provision for the payment of the use of land in the form of land tax and lease fees. The rates of land tax are established in article 2. Land tax shall be established on cadastrial documentation and be imposed on land users who are manufacturing agricultural products. Payment shall also be made for land not used for agriculture. Categories of users specified in article 9 are exempted fromthe payment of land tax. They include "dehkan", private farms during three years or one year depending upon the type of land.

    This Regulation establishes principles and procedural rules relative to the transfer of land from its assigned category to another category. The transfer is carried out by district executive committees and the Cabinet in accordance with the Land Code. The Regulations sets out the conditions under which transfer of irrigated land, arable land, plantations, etc. into another (specified) category may take place. Applications shall be made to the commissions of the district executive committees. Decisions are taken by various district or regional authorities.

    The State Committee on land Reform shall present the concept of the realisation of land reform to the Cabinet of Ministers. This Committee shall collaborate with series of central and local authorities and non-governmental entities in carrying out measures of land reform regarding special funds, payment for land, ertc. Executive committees on regional, municipal and district level shall work out specific measures for the transfer of agricultural land currently used by citizens, cooperatives, farms, etc.

    The present Law regulates relations between the State and its authorized bodies and legal and natural persons in the process of privatisation of state property. Article 4 defines the basic principles of privatisation. The Government of the Republic of Tajikistan, within the limits of its competence, shall: manage the process of privatisation of state property in the Republic of Tajikistan; approve programs for the privatisation of state property; establish the order and methods of valuation for objects, subject to privatisation make other decisions on privatisation issues.
