This Decree approves the Interim Regulations on state registration of rights to use land. Registration of land use rights is conducted by the bodies of the State Agency on Land Management and Land Resources placed under the Government of the Kyrghyz Republic (Goszemagentstvo). Part II contains principles and legal status of state registration.
This Decree approves a proposal of the Working Group, established by the Government Decree dated 4 September 1995, on the implementation of the pilot projects on land and immovable property rights registration in Kant rayon of Chui oblast and Kara-Soo rayon of Osh oblast and makes provision for the carrying out of the proposal through the setting up of a Management Group and Rayon (City) Departments of state registration of land and immovable property rights for the purpose of conducting a pilot project.
Land of the National Land Fund is transferred to the Agricultural Land Redistribution Fund under the Ministry of Agriculture and Food.
Land plots of the Agricultural Land Redistribution Fund are allocated for the establishment of new and operation of existing seed-growing, livestock-breeding, testing and selecting, experimental farms and state variety testing enterprises that are included into the list approved by the Decree of the Government dated October 4, 1994, No. 745, under condition of implementation of a thorough reform and maintenance of their specialisation in the field of livestock-breeding and seed-growing business.
Allocation of land from the Agricultural Land Redistribution Fund for the expansion of the territories of rural settlements is performed by the Ministry of Agriculture and Food in collaboration with the Ministry of Architecture and Construction, State Agency of Land Management and Land Resources under the Government of the Kyrgyz Republic and in agreement with the local state administrations. A special commission set up by the rayon state administration considers Land for the expansion of each specific rural settlement. That Commission considers also land planning issues.
This Decree contains a series of considerations and rules pertinent to land and agrarian reform and the allocation of land shares to citizens living and working in rural areas in kolkhozes and sovkhozes. Tasks of central and local authorities in this respect are formulated. It is determined that the citizens of the Kyrghyz Republic and legal persons of the Kyrgyz Republic enjoy the right to use land shares and sale, exchange, inherit, use as a collateral, rent this right to use land share. The setting up of a land reallocation fund is considered and exchange of land provided for.
This Regulation covers all the categories of agricultural land. Valuation of losses of land tenants and losses of agricultural commodities connected with expropriation of the plots of land for state and public needs as well as for individual activity of the citizens must be carried out at the preliminary stage of coordination of the situation of the object and must be specified in the process of legalization of the allotment of the plot of land.
The purpose of this Decree is to improve control over land protection and conservation. The aforesaid control shall be carried out either by state land inspectors or by social land inspectors. The latter shall be volunteers selected from the personnel of local self-government, state institutions and organizations aware of land legislation.
The Government, with a view of further extension and improvement of the land-legal relationship under the reform of the agrarian sector decrees as follows: (a) the Ministry of Agriculture and Water Resources, the State Agency on Land Management and Land Resources under the Government of the Kyrgyz Republic shall improve the land-water legal relationship and intensify the State control of efficient and purposeful use of agricultural land; and (b) the State Agency on Land Management and Land Resources under the Government of the Kyrgyz Republic jointly with the State Administration shall subs
This Governmental Decree regards auction sale of the rights to use land plots of the Land Reallocation Fund at the Ministry of Agriculture and Water Resources of the Kyrgyz Republic consisting of irrigated and dry arable land, lands with perennial plantations, hay lands and lands requiring reclamation shall be conducted with a view to promote market and land relations and increase the efficiency of land use.
