This Ministerial Decree establishes the modalities of carrying out state control over land tenure and land protection by the authorized state land institution and local self-government. This Ministerial Decree regulates management of land under protected areas, recreational land and land of historical and cultural heritage. The aforesaid categories of land shall be covered by restrictions on economic activities that may have negative impact thereon. Land of protected areas and land of historical and cultural heritage shall be exonerated from payment of taxes and levies. Expropriation of land of protected areas, recreation and historical and cultural heritage for state and public needs shall be prohibited.

The Government notes that as a result of realization of the Presidential Decree No. 874 of 1997 on allocation of 25 thousand hectares of lands for personal subsidiary farm of the citizens for increasing production of agricultural commodities there has been achieved real increase in production of grain, potatoes, rice and other agricultural commodities, improved food delivery to the population and the prices for the above-mentioned agricultural commodities have been kept under control. At the same time some mistakes have been committed as regards distribution of land plots.

This Order establishes the modalities of organization and carrying out land valuation activity, legalization of outcome thereof and access to information on land valuation. Land valuation shall be considered inventory of land areas in accordance with soil quality for subsequent cost valuation of agricultural land, land survey and stimulation of rational and efficient land management. Object of land valuation shall the plots of land with the defined legal status as established in land cadastre. Subject of land valuation shall be landowners, tenants and lease holders of agricultural land.
