    This Presidential Decree, in order to improve the efficiency and quality of vegetable, fruit and grape processing and to increase their export, mandates that the procedure for creating reorganized farms on cultivated areas of horticulture, fruit growing or viticulture cooperatives shall be run by a special commissions through open tender. Preferential rights shall be granted to cooperative members who have worked on the land in question under household contracts.

    This Presidential Decree sets up the State Committee on Land Resources and establishes the sphere of competence thereof. The Committee shall be responsible for: (a) carrying out the state policy with a view of rational use on land resources; (b) enforcement of land legislation; (c) regulation of land relations; (d) land monitoring; (e) keeping of land cadastre; and (f) soil conservation and soil fertility improvement.

    This Protocol sets up Interstate council on natural and technological disasters performing the following functions: (a) assistance in organization of cooperation between the Parties in the sphere of prevention of natural and technological disasters and mitigation of the consequences thereof; and (b) drafting recommendations for improvement of legislation related to prevention of natural and technological disasters and mitigation of the consequences thereof.

    This Provisional Instruction establishes administrative liability for the infringement of land legislation (legislative provisions related to land tenure, land survey and land cadastre). It shall be applicable to all natural and legal persons, including businesses with foreign investments, which are owners, tenants or leaseholders of plots of land. Administrative liability shall be applicable within two months from the date of commission of the offence and, in case of persistent violations within two months from the date of disclosure thereof.

    These Regulation make provision for the Government Agency on Land Organization and Land Resources at the Government of the Kyrgyz Republic (hereinafter - Goszemagenstvo), its functions, rights, and internal organization. Goszemagenstvo shall be a Republican agency of government management that shall exercise the uniform policy on management of land resources and regulation of land relations.

    Local Land Committees are executive bodies of the Land Committee responsible for land matters in oblasts, cities, rayons, and jamoat. The composition f each of these types of committees is specified. The Chairman of oblast committees is appointed by the Chairman of the Land Committee and shall have the professional qualification of "land manager". The oblast committees shall be responsible for the implementation of the national land policy, and shall supervise rational use and protection of land, and promote improvement of all farms of farming.

    This Regulation establishes that conservation of degraded agricultural land means temporary putting out of use thereof for the period of five years for the purpose of soil rehabilitation. It establishes basic principles for identification of degraded agricultural land, the modalities of exposure thereof and provisions for soil improvement and rehabilitation.

    The plots of public land can be: 1) sold or transferred free of charge into private ownership; 2) transferred on condition of permanent of temporary land tenure; 3) transferred on other conditions regulated by legislative acts or international agreements. Ownership of land is represented by private property of citizens and non-governmental legal persons. The owner has the right of possession, tenancy and disposal of land pertaining to his ownership. The Regulation consists of 14 Sections and contains 8 Annexes. Section 1 lays down the general provisions.

    This Regulation consists of IX Sections subdivided into 32 Articles and contains 7 Annexes. Section I lays down the general provisions. Section II establishes the general provisions as regards the taxation of the users of subsoil. Section III determines the modalities of calculation and payment of the taxes and charges envisaged by Tax Legislation for the users of subsoil. Section IV deals with bonuses. Section V deals with royalties. Section VI determines the production share of the Republic of Kazakhstan that is considered a royalty imposed on the users of subsoil.

    The present Regulation is made in conformity with articles 127 to 131 of the Land Code and makes provision for the compensation of economic loss resulting from (temporary) withdrawal of lands from cultivation or production of timber or other restrictions on land use rights, or damage to the quality of land caused by the State for the public interest or by private entities. It established the priority of compensation, defines means of evaluating damage, and gives directions regarding the use of funds obtained from compensation.
