This Regional Law regulates the issues of allocation free of charge in ownership to legal persons of plots of land pertaining to state or municipal property. It shall be applicable to plots of land with non-delimited plenary powers and jurisdiction that can be disposed of by local government and also to plots of land pertaining to municipal property. The aforesaid plots of land can be allocated for collective housing construction.

These Rules amend the Town and Country Planning (Inquiries Procedure) (Scotland) Rules 1997 and the Town and Country Planning Appeals (Determination by Appointed Person) (Inquiries Procedure) (Scotland) Rules 1997 by providing that those Rules do not apply to inquiries held in connection with the consideration of applications or appeals under the Planning (Listed Buildings and Conservation Areas) (Scotland) Act 1997 whose procedure is regulated by the Town and Country Planning (Appeals) (Scotland) Regulations 2008.

The present Ordinance implements both the Cantonal Spatial Information Law of 16 November 2011 and the Federal Spatial Information Act of 5 October 2007. In particular, the Ordinance lays down provisions relating to the enforcement of federal legislation in the field of geographic information and the collection, management and use of spatial data for the area of the canton Basel-Stadt. This Regional Law establishes the particulars of turnover of agricultural land. It shall be applicable to agricultural land plots and land share in common property. It shall not be applicable plots of agricultural land allocated to citizens for subsidiary smallholding, horticulture, gardening and cattle breeding. Minimum land area of agricultural land required for agricultural production shall be 1 hectare.

This Law regulates purchase of land by the foreign legal and natural persons, and also by foreign institutions and organizations that have no status of legal person but have legal capacity. It also establishes terms, conditions and restrictions on the purchase of land by foreigners. The Act consists of four Chapters divided into 17 Articles: (1) general provisions; (2) right of foreigners to purchase land, internal water and forest; (3) temporary provisions regarding the right of foreigners to purchase non-agricultural land; and (4) final provisions.

In particular, the first Part of the Ordinance deals with provisions relating to the acknowledgement and duties of experts for soil protection. The second Part lays down provisions concerning recognition proceedings for soil examining entities. The text consists of 14 articles divided into 3 Parts. Two Annexes are enclosed.
