    The present Act introduces some substantial amendments to the Water Resources Act of 31 July 2009. In particular, the Act amends article 71 dealing with expropriation procedures; article 71a on Premature possession is adds; article 78 on Building provisions for inondation areas; the following articles are added: Other protection measures for inondation areas (art. 78a); Areas at risk outside inondation areas (art. 78b); Heating oil consumer installations in inondation areas and outside (78c); Flood generations areas (78d); Right of first refusal (99a).

    The scope of this Act is to give more autonomy to the Cadastre and Public Registers Department. Article 2 provides for the establishment of Cadastre and Public Registers Agency which shall be responsible for the keeping and administration of Public Registers pursuant to provisions of the Cadastre Act. Chapter 2 makes provision for the Board and the Supervisory Board of the Agency. The Board is vested with the management of the Agency (art. 7). The Supervisory Board shall supervise the Board's management and the general course of affairs in the organization of the Agency.

    This Act places restrictions on the removal of soil on land and in the sea. It is forbidden to remove soil on public or private land without a soil removal permit (art. 3). The permit is not required for soil removal carried out to prevent flooding, for the carrying out of a Town and Country Planning Plan, or the carrying out of a Provincial Environmental Programme (art. 6). The State owns shells, sand, stones, or mud on or under surface waters of the Continental Shelf (art. 4(b)).

Under Chapter II a Technical Commission for Soil Protection is established. The Commission consists of soil protection specialists and shall advise the Minister on soil protection issues. Chapter III contains general regulations for the protection of the soil. The regulation of various matters is delegated to the Minister of Environment Protection.

    This Act concerns a special taxation regime for certain country estates for purposes of protection of the natural environment and landscape in the Netherlands. The owner of an estate may apply to the Minister so as to qualify the estate to fall with the application of this Act. Tax exemptions shall be disapplied and tax must be paid in cases when the conditions and criteria formulated under this Act cease to exist or certain requirements have not been observed by owners.
