La presente Ley tiene como finalidad la protección, el fomento y el desarrollo de las comunidades indígenas. El título II (arts. 12-22) se ocupa de manera particular del reconocimiento y protección de las tierras indígenas. A efectos de esta Ley son tierras indígenas aquellas que las personas o comunidades indígenas actualmente ocupan en propiedad o posesión históricamente, o bien en virtud de los títulos indicados en el artículo 12, así como las que los indígenas o sus comunidades reciban a título gratuito del Estado.

This Law encourages young people to become farmers by setting provisions regarding special taxation policy for agricultural land, especially for inherited agricultural land.

In the articles 26, 28, and 32 the wording “state arbitration” shall be excluded. Paragraph 1 of the article 42 acquires a new wording: “Lease enterprise shall have the right by prior consent of the owner of leased property to sell, exchange, concede on condition of free use or lend material values that make part of leased property.”

Article 17 shall be supplemented with the following wording: “….experimental areas used for scientific activity.” Article 19 acquires a new wording: “Privileges envisaged by this article shall apply to the plots of land conceded to the afore-mentioned categories of citizens for construction and maintenance of individual dwelling, subsidiary small-holding, rural housing construction, gardening and truck-farming.” Part 1 of the article 22 acquires a new wording: “Payers of land tax shall be liable for the correct calculation and timely revenue thereof to state budget.”

This Act amends the Agricultural (Commercial) Land Reform Act, 1995 so as to establish the Land Acquisition and Development Fund and to provide for its administration. The Minister may, from moneys available in the Fund, arrange for the undertaking of the development or improvement of land referred to in section 37 of the principal Act by any authority or person, subject to such terms and conditions determined by the Minister in concurrence with the Minister of Finance.

This Regional Law establishes legal grounds in the sphere of land reclamation ensuring efficient land tenure and protection of drained land. The scope of land reclamation shall be to improve productivity and sustainability of agriculture, stable agricultural production on the basis of conservation and improvement of soil fertility and involvement of unused and low-productive land in agricultural production. Land reclamation shall be classified as follows: (a) hydrotechnical amelioration; (b) agroforestry; (c) land clearance operations; and (d) chemical amelioration.

The present Act establishes that a registered owner, a municipality where the land is located, or any other person claiming an interest may apply to the Court of Queen’s Bench for an order to subdivide land. This Act applies also when two or more persons engaged in farming operations have a tenant in common title, or when a single owner actually holds the title for persons jointly engaged in farming operations of that land. The Act consists of 11 sections.

These provisions concern the rearrangement and promote the setting up of the Regole, including those regulated under Regional Act No. 48 of 1975. This Act recognizes the Regole as mountain organizations aimed at the environmental protection and economic development of mountain territories.

La presente Ley tiene por objeto el fomento, desarrollo y protección integrales del sector agrario. Para la ejecución de la política agraria (cap. IV), mediante el artículo 23, se crea el Instituto Nacional de Desarrollo Agrario (INDA), como entidad de derecho público, con ámbito nacional, personalidad jurídica y patrimonio propio, adscrito al Ministerio de Agricultura y Ganadería. El INDA substituye en sus funciones al Instituto Ecuatoriano de Reforma Agraria (IERAC).

The Law consists of 33 articles and is divided into four Chapters: General provisions (1); The Citizens' land (2); Lands belonging to the State, municipalities, cooperative farms and other legal persons (3); and Land property authorities (4).The Law regulates the ownership and use of agricultural lands. With the exception of game reserves and other nature protected areas with national and international significance, ownership is returned to owners whose land was taken under the April 1946 Law of landownership.
