Land has been and remains a politically sensitive and culturally complex issue for Kenya. Kenya’s history with regard to the land question is characterized by indications of a breakdown in land administration, disparities in land ownership, tenure insecurity and conflict. It was therefore against this backdrop that land reform was identified as an essential component of Kenya’s National Dialogue and Reconciliation (KNDR) process and in particular, agenda item 4 on addressing long standing issues.

This paper explores the role of Manhyia Palace, a traditional political office of the Asantehene (King of Asante Kingdom) in traditional land conflict management in Kumasi. Land conflicts remain a major hindrance to land use and tenure security in most parts of Ghana. Sometimes, the institutions governing land use and management are crucial to the occurrence and adjudication of these disputes. Consequently, statistics at the Accra High Court Registry shows that, land litigation ranks first in the number of cases pending with about 60,000 cases being registered in the superior courts.

“We have to work with the voice of the people,” Nai Aue Mon tells me in Sangkhlaburi, Thailand, as we discuss the recent rise of land confiscation and land disputes in the Mon State. Aue Mon has been with the Human Rights Foundation of Monland (HURFOM) since 1999, when he started witnessing the abuse and violations of the rights of civilians in the Mon State. He first began working as a journalist for the Mon publication Guiding Star, before beginning his work as documenting and defending human rights.

Public land is a resource that should be effectively managed in the public’s best interest in line with provisions of the Constitutions of Kenya and the Land Act. The management framework governing land use and development decisions on public land should ensure protection and sustainable management of the land. Despite these provisions in law, recent media reports point toresurgenceof public land grab. The Land Development and Governance Institute commissioned this research study to establish the status of the public land management in Kenya.

Las medidas de reparación integral a favor de las mujeres deben reconocer que las violencias producto del conflicto superan el episodio mismo y agudizan las brechas de inequidad y goce efectivo de derechos entre hombres y mujeres.
