This Regional Law establishes the modalities of allotment of public agricultural land to citizens for haymaking and grazing. It establishes dimensions of agricultural land parcels depending upon agricultural animal species owned by the citizens. If a citizens does not have agricultural animals then maximum dimension of agricultural land parcel allotted for haymaking shall be 0,15 ha and agricultural land parcels cannot be allotted thereto.

The present Ordinance implements various articles of the Agriculture Law of the Canton Aargau of 13 December 2011. In particular, the Ordinance outlines measures to be taken by the competent cantonal authorities. This Regional Law regulates some issues related to turnover of agricultural land, shares in common property of agricultural land, and envisages the cases of participation of municipal units in the aforesaid sphere. Privatization of agricultural land shall be effective from the date of entry into force of this Regional Law (art. 2). Minimum land area for artificially irrigated agricultural land or drained land shall be equal to field area having a separate land reclamation system but no less than 30 ha.

This Regional Law establishes maximum land parcel area destined for individual farming that can be owned or exercise other rights of use by citizens carrying out individual farming which totals 2 ha.

The Act amends the Agricultural Holdings (Scotland) Act 1991 in relation with succession and rent review and the Agricultural Holdings (Scotland) Act 2003 by adding a new provision to section 9 on the review of rent under limited duration tenancies.

The Decree issues the tables containing the average farmland rent values per acre for agricultural land lease, as well as the presumptive rent deriving by the free of charge concession of agricultural land to any third person, for all the regions and prefectures of the state.

These Regulations amend the Registration Duty Act in Part VII of the First Schedule (which specifies rates of registration duty) and in the Second Schedule in item 4A. The Second Schedule concerns calculation of the value of property for duty purposes.

The scope of this Regional Law shall be to ensure rational land tenure, protection of land rights of citizens, improvement and state regulation of land relations. This Regional Law shall be applicable to land ownership, land tenure, tenancy of land parcels and land shares. It establishes minimum and maximum parcels of agricultural land that can be owned by a single natural and legal person, minimum period of lease of agricultural land.

The present Ordinance implements the Federal Act on agricultural lease of 4 October 1985. In particular, the Ordinance defines the competences and proceedings in the implementation of the federal legislation on agricultural lease. This Act makes provision with respect to small holdings i.e. any land or parcel of land with or without a dwelling house or other building erected or to be erected thereon not exceeding in all five acres in area let for agricultural purposes and of a specified maximum total value. The Act specifies the (contractual) rights of a tenant of a small holding including the use and enjoyment of all ground crops, plants, fruit trees or other trees. The Act also specifies rights of the landlord and provides with the resolution of disputes between the parties to any contract under this Act.

This Presidential Decree approves the mid-term Development Plan 2009-2013 for the Province of Huíla (in the Annex). The above mentioned Plan specifies the projects prescribed by the General Budget of 2012 under the Development Programme of this Province. Moreover, this Plan establishes priority projects to be assessed and eventually implemented and treated in coordination with the executive central services.
