This Regional Law regulates relations concerning turnover of agricultural land within plenary powers pertaining to the jurisdictional competence of the regional administration. Privatization of agricultural land pertaining to regional state or municipal property shall begin from 1 January 2004. Minimum consolidated agricultural land plot area shall be two ha.

This Regional Law regulates relations concerning turnover of agricultural land, including land shares in common property, within plenary powers pertaining to the jurisdictional competence of the regional administration. Only agricultural land plots that have passed cadastre registration shall be authorized for purchase and sale. Local government shall have preferential terms for purchase of agricultural land in case of sale thereof at face value, except for sale through public tenders and except for expropriation of land plots for public and municipal needs.

This Regional Law regulates some relations concerning turnover of agricultural land and land shares in common property, and also classification of land plots as particularly precious productive agricultural land plots. Minimum consolidated land plot shall be equal to 1, 9 ha. Agricultural organizations and peasant farms having agricultural land plots on condition of permanent (open-ended) or hereditary tenancy shall be granted the right of purchase in ownership thereof at the price of 15 percent of cadastre value of the aforesaid agricultural land plots.

This Law regulates relations concerning ownership, land tenure, and disposal of agricultural land, and also land shares in common property, establishing plenary powers of regional administration and local government in the sphere of turnover of agricultural land. It lays down terms and conditions for allotment of plots of agricultural land pertaining to state and municipal property. Agricultural land shall be used exclusively for agricultural production. Privatization of agricultural land shall start from the date of entry into force of this legislative act.

This Regional Law establishes legal grounds for state regulation for ensuring agricultural land fertility. Authorized state regional land institution shall perform the following plenary powers: (a) elaboration and realization of measures for economic stimulation of landowners, tenants, including leaseholders for soil improvement with a view of ensuring agricultural land fertility; (b) public investments in ensuring agricultural land fertility; (c) promotion of agrochemical treatment of agricultural land; and (d) monitoring of agricultural land.

This Act concerns partition of all lands the subject of any co-tenancy, whether held or acquired before or after its passing. All joint tenants and tenants in common of any estate on which they have specified rights may be compelled in manner provided for in this Act to make severance and partition between them of all such lands respectively. A Court may order partition on application The Court may also order sale of the land concerned. A motion for partition shall include a motion for sale and distribution of the proceeds, and vice versa.

This Act provides for sale and lease of land, and any estate or interest therein, which is the subject of a settlement. “Settlement” signifies any act, deed, agreement, will or other instrument under or by virtue of which any land or any estate or interest in land stands limited to or in trust for any persons by way of succession. Settled estates may be sold or given in lease under authority of the High Court or by a tenant for life.
