Background and context
With the decentralization processes underway in most countries of the Congo Basin, community involvement in decision-making is becoming an imperative, particularly with regard to land and resource management (Beatty, M.T. et al. (1978). To ensure that this involvement results in a clear and sustained expression of community needs, it is important to think of an integrated, free and committed approach to communities in order to promote a dialogue between land management actors (Joe Watts, 1994).

Dans le même temps, les systèmes fonciers traditionnels n’ont pas pu exprimer tout leur potentiel face à l’hégémonie du droit étatique et du fait des pratiques inégalitaires qu’ils soutiennent à l’égard de certains groupes, comme les femmes, les allochtones et les jeunes.

Au Cameroun, l’augmentation des investissements à grande échelle, dans des secteurs tels que l’agro-industrie, l’exploitation minière et forestière, a entraîné de nombreux transferts de droits fonciers des communautés locales vers les acteurs commerciaux. Mais ces transferts négligent souvent les droits des communautés à la consultation, à l’information et au consentement. Indonesia represents an interesting case for analysis of the relationship between multi-level governance and climate governance for three main reasons. It is a highly decentralized country; it is a major contributor to land-based greenhouse gas emissions; and it is extremely vulnerable to climate change. The chapter first provides a broad overview on Indonesia’s climate governance in the context of decentralization, and then focuses on sub-national governance of climate change mitigation in the land use sector, the largest contributor to greenhouse gas emissions in the country.

The concept of ‘fit-for-purpose land administration’ (FFPLA) offers a way forward by advocating a shift towards a more flexible, pragmatic and inclusive approach for land rights recording. Inherently, the process and outcome of implementing FFPLA will have significant socio-political ramifications but these have not received much attention in the literature; additionally, few papers have considered this in the context of decentralization, an endorsed strategy for implementing FFPLA.
