Regional Law No. 105 “On particulars of regulation of land relations”.

This Regional Law regulates land relations concerning land-use planning, urban land zoning and land tenure of public land. It establishes that land tenure shall be performed exclusively in accordance with purposeful use of land. Land classification by categories, including classification of public and municipal land as agricultural land, transfer of land from one category to another shall be carried out by the supreme regional executive body.

This Regional Law establishes categories of workers that have the right to service land allotment. Service land allotment shall be granted to: (a) game managers and gamekeepers; (b) forest officers and workers of forestry organizations; (c) fishery managers and fishermen of coastal fishery organizations; (d) railway line personnel and highway maintenance and keeping personnel. Service land allotment shall be granted for gardening, vegetable growing, stockbreeding, haymaking and grazing.

Regional Law No. 44-11 “On legalization of land plots for individual housing and suburban construction, and gardening”.

This Regional Law establishes the modalities of legalization of the rights of ownership to public land plot allotted to a citizen for individual housing and suburban construction or for gardening if the documents of ownership by application of estate-leaver were not legalized during the lifetime. In the aforesaid case the heir shall have the right of allotment free of charge of the plot of land applied for by estate-leaver while alive.

Regional Law No. 1500-OD “On fixation of land buy-back price in case of allotment in ownership of agricultural land plots for gardening, horticulture and subsistence farming”.

This Regional Law regulates transfer of agricultural land parcels in ownership to gardeners, vegetable growers and subsistence farmers, and to non-commercial associations thereof, out of stock of public and municipal land, except for cases of transfer free of charge envisaged by the national legislation. Buy-out price shall be fixed at 20 percent of cadastre value for agricultural land and 10 percent of cadastre value for urban land.

This Regional Law establishes rates of allotment of public land parcels to citizens for farming, gardening, horticulture and stockbreeding as follows: (a) agricultural land for peasant farms – 200 ha; (b) for gardening, horticulture – 0,15 ha per family; (c) land for stockbreeding shall be calculated by livestock species but shall not exceed 0,50 ha. Allotment free of charge of public agricultural land to citizens that have the right to such allotment shall not exceed 0,50 ha.

This Regional Law regulates relations in the sphere of elaboration, composition and the modalities of realization of regional land-use planning with the consideration of sustainable development of territory, distribution of protected areas and mapping of the boundaries of agricultural land. Decision of elaboration of regional land-use planning scheme shall be made by the regional administration.

El presente Decreto modifica el artículo 69 de la Ley para la modernización y desarrollo del sector agrícola, en lo que respecta a la creación por parte del Estado de mecanismos que faciliten la adquisición de terrenos rurales. La nueva disposición establece que el Instituto Nacional Agrario podrá adquirir los terrenos de sus legítimos propietarios en caso de conflictos agrarios por tierras.

La presente Ley declara de interés general que los titulares del derecho de propiedad sobre los inmuebles rurales y las explotaciones agropecuarias sean los siguientes: personas físicas, sociedades personales, sociedades agrarias, asociaciones agrarias, cooperativas agrarias, sociedades de fomento rural, personas públicas estatales y personas públicas no estatales. Asimismo, indica las condiciones en las que podrán ser titulares las sociedades anónimas y en comandita por acciones.

Article 25.2 of the Federal Law No. 122-FZ on state registration of immovable property and its transactions shall acquire a new wording: “The grounds for the state registration of the ownership right to a plot of land shall be: (a) deed on allotment of a plot of land; (b) land certificate attesting the right of citizen to a plot of land; (c) vidimus issued by the local self-government (if the plot of land has been allotted for subsidiary small-holding); (d) any other certificate attesting the right of citizen to a plot of land”. This Presidential Decree establishes the modalities of preparation of documentation, registration and issuance of certificates for land plots allotted in ownership, tenancy and lease to natural persona, legal persons of Turkmenistan and foreign states, and also to foreign states and international organizations. Land plots can be conceded in ownership to Turkmenistan nationals for subsidiary smallholding in rural areas, and for individual housing construction in the towns and townships.
