This Law establishes the forms of property and ownership, legal and economic grounds in the sphere of property relations, and sets forth terms and conditions of the origin of property rights, ensuring protection and conservation of property. Objects of ownership can be land, subsoil, mining allotment, water resources, air space, forest fund, flora, fauna, and intellectual property.
This Law establishes the purpose, obligations and legal grounds regarding the registration of immovable property and related transactions. The following rights to immovable property shall be subject to state registration: (a) ownership; (b) economic management; (c) operating management; (d) land tenure of at least one year; and (e) servitude for a period of no less than one year. The following pre-emptive rights shall not require mandatory state registration: (a) land tenure for a period less than one year; and (b) servitude for a period less than one year.
The present Law regulates relations between state institutions, natural and legal persons in the sphere of geodetic and cartographic activity. The Law consists of 18 articles. Article 1 introduces the main concepts. Article 2 specifies legislation in the sphere of geodesy and cartography. Article 3 classifies objects and subjects of geodetic and cartographic activity. Article 4 specifies the main directions of geodetic and cartographic activity. Article 5 establishes the competence of the government. Article 6 establishes the competence of the authorized institution.
The main targets of state housing policy are concession of compensation to low-income categories of citizens for the payment of communal services, stimulation by the state of the maintenance of housing facilities by economic and financial means, creation of favourable vital environment equipped with the necessary social, communal, cultural and other services. This Law regulates the totality of relations in the sphere of land use planning and land survey practices. The Act consists of 5 Sections divided into 37 articles: (1) general provisions; (2) management of land use planning activity; (3) types of land use planning and land survey activities; (4) land use planning documentation; and (5) conclusive provisions.
This Law regulates legal, economic and organizational grounds of relations originating from, acting and cessation of mortgage.
This Law regulates relations concerning municipal property and, in particular, land relations. Article 3 establishes that public parks, urban green belts, forests and agricultural land not pertaining to protected areas can be in municipal ownership. Article 5 states that municipal property can be obtained through transfer, purchase, donation, exchange and expropriation. Article 12 establishes that objects of municipal property can be privatized by natural and legal persons. Article 15 establishes that municipal property can also be conceded to natural and legal persons on lease.
Local government shall be responsible for supervision over land-use planning of urban land in residential areas. This Housing Code shall establish requirements for acknowledgement of land plots destined for residential areas and the establishment of the boundaries thereof. It also regulated the issues of expropriation of land plots under residential facilities for public need and the modalities of compensation to the owners of the aforesaid residential facilities. The right of ownership to land plot under residential facility of the owner thereof shall be regulated by land legislation.
This Law regulates legal relations in administration of agricultural land and aims at promotion of efficient and safe use of land in the interests of the people of the Kyrgyz Republic. Land is a national treasure of the Kyrgyz Republic and the property of the people, which lives on its territory. (art. 5). The State and exclusively citizens of the Kyrgyz Republic who permanently reside in rural location for at least two years have the ownership right to agricultural land in the Kyrgyz Republic (art. 6).
This Law establishes that agricultural land shall be exclusive property of the state and of citizens permanently living in rural areas for at least two years. Allotment in ownership and transfer of agricultural land shall be prohibited to: (a) foreign natural and legal persons, and foreign states; (b) stateless persons living on the territory of Kyrgyzstan; (c) legal persons of Kyrgyzstan and joint-ventures; and (d) married couples if one conjoint is foreigner or stateless person.
