The following amendments and addenda must be introduced to the Federal Law No. 101-FZ: 1) Item 1 of the Article 4 must be supplemented with the wording “artificially irrigated land and drained land”; 2) Item 4 of the Article 10 must be supplemented with the following paragraph “Agricultural land conceded to the agricultural organizations in permanent (open-ended) tenure may be conceded in ownership to natural persons free of charge in conformity with the Article 28 of Land Code in cases envisaged by the regional legislation.”

The present Law determines economic, legal and social basis of the organization and functioning of peasant associations. Peasant association is and autonomous economic entity with the status of legal person set up on voluntary basis by persons engaged in agricultural production. Peasant associations can be set up as state, cooperative, mixed and other forms of property (art. 1).

La présente loi met en exécution la loi fédérale sur l'aménagement du territoire du 22 juin 1979. Elle a pour but d'assurer une utilisation rationnelle et mesurée du sol, ainsi qu'un développement économique harmonieux, conformément aux objectifs et aux exigences de la loi fédérale sur l'aménagement du territoire. Le texte comprend 46 articles répartis en 4 chapitres ocmme suit: Dispositions générales (1er); Tâches du canton (2); Dispositions transitoires et finales (4); Tâches des communes (3).

Article 5 of the Law No. 214-1 on peasant farm acquires a new wording: «The plot of land of a peasant farm shall be inherited according to the modalities envisaged by the national legislation». Article 6 of the same Act acquires a new wording: «The plots of land for farming shall be allotted to the citizens of the Republic of Kazakhstan on condition of ownership or on condition of temporary charged lease for the period up to 49 years and for seasonal grazing on condition of temporary land tenure free of charge».

Article 1 shall be supplemented with items 23 and 24 of the following contents: "23) homestead land – is not a plot of arable land but an allotment granted by state executive bodies or local self-government to citizens for individual construction with the adjoining plot of land; 24) lawn-and-garden land – is a plot of land granted by state executive bodies or local self-government to enterprises, institutions and citizens for the organization of gardening cooperatives for the purpose of production of agricultural commodities, vegetables and fruits."

This Law regulates legal relations in administration of agricultural land and aims at promotion of efficient and safe use of land in the interests of the people of the Kyrgyz Republic. Land is a national treasure of the Kyrgyz Republic and the property of the people, which lives on its territory. (art. 5). The State and exclusively citizens of the Kyrgyz Republic who permanently reside in rural location for at least two years have the ownership right to agricultural land in the Kyrgyz Republic (art. 6).

This Law sets forth the rules and principles for determining land and soil resources and their classification, preparing land utilization plans, preventing non-purpose utilization, and defining the tasks and obligations to ensure land and soil preservation. Soil Preservation Boards are established in each province to examine, assess and monitor the activities related to the preservation, development and productive utilization of lands. Lands are classified as absolute farming lands, special crop lands, cultivated farming lands and marginal farming lands.

Section 4 regards specific nature of mortgage (hypothecation) of land sites. It specifies that According to agreement on hypothecation, land sites in ownership may be given to mortgage. Hypothecation of land sites in collective ownership in residential areas, including those in towns, where in accordance with regulations on urban development it is prohibited to erect buildings and structures at specially protected territories and in zones, land sites intended for special use, belonging to state or municipal bodies, is not permitted.

Control and regulation is necessary to provide for the orderly growth and harmonious development of the territory and to achieve various purposes including: to secure adequate provisions for water supply, drainage, sanitary sewerage and other health requirements and to permit the conveyance of land by accurate legal description.
