La presente Ley declara de interés general que los titulares del derecho de propiedad sobre los inmuebles rurales y las explotaciones agropecuarias sean los siguientes: personas físicas, sociedades personales, sociedades agrarias, asociaciones agrarias, cooperativas agrarias, sociedades de fomento rural, personas públicas estatales y personas públicas no estatales. Asimismo, indica las condiciones en las que podrán ser titulares las sociedades anónimas y en comandita por acciones.

Article 25.2 of the Federal Law No. 122-FZ on state registration of immovable property and its transactions shall acquire a new wording: “The grounds for the state registration of the ownership right to a plot of land shall be: (a) deed on allotment of a plot of land; (b) land certificate attesting the right of citizen to a plot of land; (c) vidimus issued by the local self-government (if the plot of land has been allotted for subsidiary small-holding); (d) any other certificate attesting the right of citizen to a plot of land”. The present Regulation lays down provisions relating to the alienation and leasing of agricultural lands in the domain of the State. In particular, it applies to the alienation and leasing of ungranted land, except land designated for blueberry production.

The present Regulation lays down provisions relating to the alienation of agricultural lands in the domain of the State to certain occupants. For the purposes of this Regulation, an occupant is a person who, at 1 July 1984, occupied without right a parcel of land that was ungranted or that has become ungranted since that date. The Minister may, at any time, register in respect of a parcel of land, whether occupied or not, a declaration stating that it forms part of the public domain.

This Guideline lays down the procedures and requirements for changing the category of agricultural lands and resources. It consists of three parts: (I) Changes of the agricultural land category due to the land qualities degradation as a result of force majeure; (II) Changes in resources categorization; (III) Agricultural land analysis in case of no other available data.

This Regulation lays down amendments and addenda to Regulation No. 531 of 1998 on non-divided agricultural lands. According to these new provisions, undivided agricultural lands, as identified by the competent municipal commission and certified by the chief of the immovable property registration office, can be rented by the local government to foreign and domestic individuals or legal entities.

The present Regulation implements the Agricultural Tile Drainage Installation Act (R.S.O. 1990, Chapter A.14). In particular, it lays down the terms and conditions required to install drainage works. Furthermore, it establishes classes for machine operators. The text consists of 16 sections.

La Commission Foncière Rurale (CFR), créée par le Ministère de l'Agriculture et des Ressources Animales, est réorganisée conformément aux dispositions du présent arrêté. La CFR est un organe inter-sectoriel de suivi de la situation foncière rurale et de réflexion sur les conditions de l'optimisation de la gestion foncière considérée comme un élément de développement rural et d'amélioration des conditions de vie des producteurs du secteur agricole.

Le présent arrêté a pour objet de préciser les modalités de fonctionnement des Comités de Gestion Foncière Rurale (CGFR) créés par des arrêtés préfectoraux en application du décret n° 99-593.

Le présent décret porte organisation et attributions des comités de gestion Foncière rurale (c.g.f.r), organes de gestion foncière rurale qui délibèrent sur la validation des enquêtes officielles de constat de droits fonciers coutumiers; les oppositions ou réclamations survenant au cours des procédures d'immatriculation des terres du Domaine Foncier Rural concédé; les conflits non résolus au cours des enquêtes foncières; les demandes de cession de droits fonciers coutumiers; l'implantation des opérations de reboisement et des projets d'urbanisation.

Toute personne, tout groupement informel d'ayants droit, se disant détenteur de droits sur le Domaine Foncier Rural coutumier, doit faire constater ces droits dans les délais prescrits par la loi n° 98-750. Le constat est effectué au terme d'une enquête officielle réalisée aux frais du demandeur selon les modalités déterminées par les dispositions du présent décret. Dès réception du dossier de l'enquête officielle, le Directeur départemental de l'agriculture et des ressources animales contrôle ce dossier et prépare le certificat foncier qu'il soumet à la signature du Préfet de Département.

Les concessionnaires à titre provisoire de terres du Domaine Foncier Rural sont tenus, sauf à y renoncer, de consolider leurs droits ainsi qu'il est précisé par les dispositions du présent décret.
