The document "Charte Relative à l'Accès à l'Information et au Partage de Connaissances" underscores the significance of access to comprehensive, objective, and reliable information for all citizens as a fundamental human right. It recognizes the adoption of a charter regarding access to information and knowledge sharing as vital to the promotion and protection of human rights, in line with Article 45 of the African Charter on Human and Peoples' Rights. The charter also highlights the importance of transparency and accountability in preventing corruption and promoting democracy, allowing citizens to track the management of state affairs and public funds, and fostering citizen participation in public life.
The charter defines public bodies and public information and acknowledges the right to information as both an international and national human right, as guaranteed by Article 19 of the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, and Article 11 of the Constitution, respectively. It proposes principles for better access to public information, administrative documents, and any information of general interest. The charter also acknowledges the constitutional principle of the right to information of every individual and commits to ensuring and facilitating public access to, understanding of, and use of all information and documents held or likely to be held in the future, subject to certain limitations. The parties to the charter retain the power to regulate access, transfer, exchange, sharing, and use of the information they hold or are likely to hold in the future. However, no regulation thus formulated can prevent total or excessive access.
