This Order concerns powers of compulsory purchase, powers of entry, and compensation of the Environment Agency and local authorities under sections 38 and 39 respectively of the Flood and Water Management Act 2010 for purposes incidental flooding and coastal erosion works. Those sections empower the Environment Agency and local authorities to carry out certain works in the interests of nature conservation, the preservation of cultural heritage or people’s enjoyment of the environment or of cultural heritage.

Towns Nuisance Prevention Act.

This Act introduces measures to prevent nuisances in parishes. The Parish Council shall have powers to abate any imminently dangerous nuisances and may declare land to be a public nuisance. If the land in question is not cleaned, the Council may petition to court to have the land sold. The court may issue a condition order for sale. This order initiates to the procedure for sale of the land. The court may also order cleaning of the land. The Act also concerns properties on the seashore.

These Regulations provides rules for the berthing of fishing vessels. The Regulations, among other things: designate landing areas; prohibit hauling or berthing of fishing vessels outside such sites and construction of structures within sites without a permission of the Chief Fisheries Officer; prescribes fees for the use of structures and prohibits damaging of such structures.

These Regulations amend the Fisheries (Berthing) Regulations in regulations 5 and 7 and Schedules I and II. Regulation 5 (on use of public structures at landing areas) is amended by defining “public structure or facility” as any structure erected or facility established for fisheries purposes at a designated fish landing site. Regulation 7 (on the payment of fees) of the Principal Regulations is amended in paragraph (a) by inserting after the word “Chief Fisheries Officer” the following: “or the designated authority.”

These Regulations designate a coastal area as a Special Protection Area in accordance with Article 4 of Directive 2009/147/EC of the European Parliament and of the Council on the Conservation of Wild Birds. The purpose is to ensure survival and reproduction of all species of birds to which Article 4 relates and in particular those listed in Schedule 3 to these Regulations. Schedule 4 lists activities that require the consent of the Minister and may cause disturbance or damage to birds protected under Schedule 3.

The purpose of this Act is to protect national coasts to avoid flooding and degradation of land from the sea, fiords and other territorial sea areas. The purpose of this Regulation is to clarify the national land policy in the 100-meter coastal belt. The aim is to safeguard public interests and prevent unfortunate construction along lakes, in accordance to the Planning and Building Act. The Regulation ensures that a stronger geographic differentiation is suggested for the key areas where pressure on land is high.

This Presidential Decree, consisting of 2 Chapters, regulates spatial planning for public lands within the coastal area of the Province of Luanda transferring them to the private sector, according to Law No. 9/98. In particular, it regulates the public coastal lands and public territories within the maritime areas destined to the settlement of infrastructures and support equipments, not only limited for beach facilities, but also for the entire marine coastal zones within the Province of Luanda.
