Tenantries Freehold Purchase Act.

This Act regulates the purchase of freeholds in tenantries. A tenantry means a tenantry specified in the First Schedule (a plantation tenantry) and an area of land, including public land, subdivided before a specified date into lots for letting for specified purposes. “Tenantry” does not include land adjoining the foreshore. The purpose of this Act is to establish by law a right for tenants of lots in tenantries who satisfy the requirements of this Act to purchase the freehold at a purchase price governed by considerations of public policy and the requirements of the Constitution.

Regulation No. 29 of State Committee on Land Resources regarding conservation of degraded agricultural land.

This Regulation establishes that conservation of degraded agricultural land means temporary putting out of use thereof for the period of five years for the purpose of soil rehabilitation. It establishes basic principles for identification of degraded agricultural land, the modalities of exposure thereof and provisions for soil improvement and rehabilitation.

Resolution No. 346 of 2007 on the estimation of reimbursements and compensations for cultivated lands, plants and trees located in lands confiscated for public utilities or included in land improvement projects.

The aim of this Resolution is to define and estimate compensations and reimbursements for damages caused to cultivated lands, plants and trees, produced by land improvement projects and public utilities. It is composed of 3 articles. The estimation of the aforementioned compensations and reimbursements shall be valuated by the specialist committees established by Prefects according to land quality, kind of crops, age and the like (art. 1). Article 2 abrogates all resolutions, rules, regulations and the like, which are incompatible with the present Resolution.

This Act provides for local government in Guyana. It defines functions and powers of village councils, country councils and rural authorities.The Minister may enforce obligations of local authorities in the field of supply of water and sewerage and may exercise the powers of a local authority whenever is appears expedient to the Minister to do so. The Minister may also make By-laws for, among other things, the management and administration of villages and country districts and rights relating waterworks between villages or country districts.

This Act provides for local government of Amerindians, i.e. an Indian who is a member of a tribe indigenous to Guyana. For this purpose Amerindian Districts, Amerindian Areas and Amerindian Villages are established.The Act also provides for the protection of property of Amerindians and establishes the Amerindian Purposes Fund. The Minister may establish District Councils or Area Councils as a body corporate. The Councils shall, among other things, manage and regulate the use and occupation of land situated in a District, Area or Village.

Local Improvements Act.

This Act concerns laying-out and subdivision of land for purposes of local improvements in infrastructure such as water supply and sewerage. The Act shall not apply land of a certain size intended for cultivation or pasturage. Land on the foreshore shall be subject to limitations regarding laying-out and subdivision of land and decisions regarding laying-out and subdivision of land by a local Council may be revised by the Minister.

Article 1 of the above-mentioned Law establishes that the right of passage allows persons, animals and their appurtenances to pass over somebody else’s property. This Order regulates state cadastre valuation of agricultural land, but does not apply to state cadastre valuation of land used for gardening, market gardening or hobby farming associations. State cadastre valuation shall classify agricultural land into one of six categories: (a) cultivated land; (b) protected forest belts and disturbed land; (c) land under landlocked waterbodies; (d) shrubbery and tree plantations (except for protection forest belts); (e) forestland not transferred to the forest fund in open-ended ownership or uncompensated use; and (f) reindeer pastureland.

Methodical Instruction on the partition of agricultural land into shares.

This Methodical Instruction provides for the partition of agricultural land into shares to divide common property ownership. Each holder of common property shall have the right to separate out its share, establish the location of its land plot and determine the amount of compensation to the common property holders. Partition of irrigated agricultural land pertaining to common property shall be prohibited if the separated land area is less than the minimum size for reclaimed land established by the regional authority.

Ordinance implementing the federal rural soil legislation.

The purpose of the present Ordinance is to regulate the enforcement of the federal legislation on rural land law. Article 2 lays down provisions relating to the composition and tasks of the Land Law Commission. The text – consisting of 12 articles – deals with the following matters: land valuation, competent surveying authority, proceedings, sphere of application, agricultural land and entry into force.
