This Act provides for the leasing of agricultural land, forest land, meadows and pastures that are property of the State. The Act consists of 18 articles and is divided into five chapters: general provisions, the contractual terms of leasing, the time terms of land leasing, the minimum size of land and the approval of request.

This Law concerns the management of non-divided agricultural land and the lands that have been refused in ownership or usage although granted under the Law No. 7501 of 1991. The Acts provides for land use planning and for actions to be taken in case of illegal occupation, abuse and damage of agricultural land (article 6).

The Law consists of 25 Articles. The present Law determines the juridical, organizational and economic peculiarities of leasing and is aimed at attracting investments on the basis of leasing activity. Enterprises and other property complexes, buildings, structures, equipment, transport means and other movable and immovable property pertaining to the main means can be subject to leasing.

Majlis Oli (Parliament) decrees to make the following amendments: In the issue “a” of the first part of the Article 17, third and sixth parts of the article 31, second part of the Article 70 and in the Article 73 the wording “Attestation on the right of land use” must be substituted with the wording “Certificate of the right of land use”.

The President, for the purpose of more efficient use of agricultural land and simplification of taxation decrees to introduce from 1 January 1999 single land tax for all the producers of agricultural commodities. The payers of single land tax shall be: (a) agricultural cooperatives (shirkats), farms and other producers of agricultural commodities except for dehkan farms.

Land is the public property and it shall not be liable to sale, exchange, donation, mortgage except for cases envisaged by the national legislation. Legal persons can manage land parcels on condition of land usufruct, permanent use, temporary use, and lease, while natural persons can manage land parcels on condition of lifelong hereditary land tenure, temporary land tenure and lease.
