This Act repeals specified provisions of the Cook Islands Act, 1915 in the manner indicated in the First Part of the Schedule to this Act and various amendments listed in the Second Part of the Schedule to this Act. The amendments to the principal Act concern, among other things, proceedings and other matters of the Land Court and proceedings with the High Court and the alienation of native land.

This Act amends provisions of the Cook Islands Act, 1915 with respect to the alienation of native land. Subsection (2) of section 475 of the principal Act is hereby amended by omitting, the words "the High Commissioner" and substituting the words "an officer of the Land Court approved in writing for the purpose by the Secretary of Justice". Section 482 of the principal Act is hereby amended by repealing subsection (3).

El presente Reglamento dispone que para formalizar su personería jurídica, la comunidad campesina será inscrita en el Libro de comunidades campesinas y nativas del Registro de Personas Jurídicas de la Oficina Registral, por resolución administrativa del órgano competente en asuntos de comunidades del Gobierno Regional correspondiente.

La présente loi fixe le cadre qui détermine les différents statuts des terres et pose les principes qui doivent les présider. La loi, par la suite, énumère les différents statuts des terres en donnant leur définition, consistance, régime juridique et mode de gestion. Ces statuts concernent notamment : les terres dépendant des domaines de l’Etat, des collectivités décentralisées et des autres personnes morales de droit public ; les terrains des personnes privées et les terrains constitutifs d’aires soumises à un régime juridique de protection spécifiques.

The Parties, on the basis Treaty between Papua New Guinea and Solomon Islands concerning Sovereignty, Maritime and Seabed Boundaries between the two countries and co-operation on Related Matters, signed at Port Moresby on 25 January, 1989 (“the Treaty”), regulate various activities in the Border Area as defined by the Treaty and further defined in this Agreement.

The Ministerial Decree regulates mortgage of the plots of land and traditional land rights related to land based credits. Plots of land in private ownership, land rights and shares of a plot of land in joint ownership or in joint land tenure can be mortgaged. The following land categories shall not be mortgaged: (a) common land; (b) defence land; (c) protected areas; (d) public land allotted for temporary land tenure to the officials. Physical and non-governmental legal persons owning plots of land or exercising land rights thereto can be depositors.

This Act establishes a Provisional Commission for the Zoning of Ancestral Lands, requires the Commission to complete a comprehensive zoning plan for all properties and parcels under the jurisdiction of the Guam Ancestral Lands Commission in accordance with provisions this Act and prescribes procedures for the final approval of the plan. In formulating the comprehensive zoning plan, the Provisional Commission shall request and consider the opinions of all affected ancestral land claimants.

This Act provides specific authorization for cottage industry activities on Chamorro Land Trust residential lots to be conducted by Chamorro Land Trust residential leaseholders. Authorized cottage industry activities include farm production and light agriculture activities, baking and manufacturing of foodstuffs and growing and selling of plants and flowers. The Chamorro Land Trust Commission shall promulgate Rules and Regulations governing cottage industry activities.

This Act inserts aquaculture as a “best use” purpose for which Chamorro Homelands are to be leased and prescribes certain requirements regarding the activity of aqualculture on Camorro land. The Chamorro Land Trust Commission is authorized to lease to native Chamorros the right to the use and occupancy of Chamorro homelands within specified acreage limits for each lessee. The lessee of aquaculture lands shall install and maintain a specified type of pool, pound or tank approved by the appropriate agencies.
