This Act provides special rules relative to the integrated approach for the improvement of the quality of areas that are particularly problematic as regards town and country planning, nature, forest resources, recreation, water and the environment in general (concentration areas). A reconstruction shall take place in concentration areas in accordance with this Act.

According to Law No. 10257, the Section of Land Administration and Protection is replaced with the Directorate of Land Administration and Protection. At local level, it is created the Department of Land Administration and Protection (DLAP) composed by the land administration section and the land protection inspectorate. The DLAP prepares and submits for approval to the municipal authorities all the requests and documentation for land leasing, exploitation and other forms of ownership transfer. Its duties and tasks are further enumerated.

This Law provides for the control on the transfer of rights in agricultural land in Jersey. Sale, transfer or lease of agricultural land requires approval of the Minister for Planning and Environment. The Minister may refuse consent to any transaction or may grant consent either unconditionally or subject to such conditions as the Minister thinks fit.

These Regulations exempts certain transactions from restrictions on transfer and sale of agricultural land put in place by article 2 of the Agricultural Land (Control of Sales and Leases) (Jersey) Law 1974.

This Law provides for the protection of the quality of agricultural land, i.e. land used for horticulture, fruit growing, seed growing, dairy farming, the breeding and keeping of livestock, and grazing land, meadow land, market gardens and nursery grounds.

Article 4 shall be amended to acquire a new wording: “Formation of a new land plot shall not be allowed if it is incorporated into irrigated agricultural land and (or) drained land if its area is less than minimum area set by regional authorities for irrigated and drained agricultural land”. Article 6 shall be amended to acquire a new wording: “Plot of agricultural land can be expropriated if it is used with violation of rational land use requirements entailing agricultural land fertility reduction of deterioration of ecological situation”.

This Law aims to protect the soil and gives provisions relating to the control of tillage operations. This Law prohibits the agricultural land leveling and sand beaches dredging. Any action evolving the removal of soil or any part of the earth’s surface is forbidden by the provisions of this Law. The tillage operations necessary for farming in the agricultural lands belonging to individuals are not prohibited. The Ministry of Municipal Affairs and Agriculture may licence the agricultural land leveling and sand beaches dredging to improve and maintain the soil fertility.

This Law provides for land use and development planning in Guernsey and control over development. Its purposes are to protect and enhance, and to facilitate the sustainable development of, the physical environment of Guernsey, to protect natural beauty to preserve and promote biological diversity. A Strategic Land Planning Group shall be appointed from various state offices and shall Strategic Land Planning Group be involved in the preparation or amendment of the Strategic Land Use Plan.

This Law amends the Preservation of Natural Beauty and Control of Agricultural Land (Guernsey) Law, 1959 in section 2 in relation with the number of members that shall constitute the Natural Beauty and Control of Agricultural Land Committee.

This Law provides for the preservation of natural beauty of Guernsey and the control of development of agricultural land and for these purposes provides for the appointment by the States of the Preservation of Natural Beauty and Control of Agricultural Land Committee. The Law principally grants legislative powers to the States for the purposes of this Law. Ordinances of the States shall provide for a system of authorization of development of agricultural land and certain activities affecting the landscape.

The present Ordinance implements Federal Agricultural Lease Act of 4 October 1985. Article 2 nominates the Agricultural Office responsible for the enforcement of the above-mentioned Act. The text consists of 8 articles.
