    These Regulations concern the procedure on conversion of customary tenure into leasehold tenure. A person: (a) who has a right to the use and occupation of land under customary tenure; or (b) using and occupying land in a customary area with the intention of settling there for a period of not less than five years; may apply for conversion to the Chief of the area where the land is situated in Form I as set out in the Schedule. Refusal of the request shall be communicated to the Commissioner of Lands in Form II.

    These Regulations make provision for the constitution of a Lands Development Fund Committee whose function shall be to consider and determine applications for disbursement of funds from the Lands Development Fund created under the Lands Act. Any Council wishing to apply for disbursement of funds from the Fund to develop any area in its locality may apply to the Secretary for money to develop that area, provided that the funds from the Fund shall only be used to carry out development which the private sector cannot provide.

    These Regulations provide for procedures of lodging an appeal to and proceedings before the Lands Tribunal constituted under the Lands Act and certain powers of the Tribunal. An appeal to the Tribunal against any directive or decision may be instituted by sending to the Secretariat. Subject to specified conditions, the Tribunal may inspect the land or hereditament which is the subject of the proceedings and may, if it thinks fit, enter on the land or hereditament for that purpose.

    This Act provides with respect to perpetual succession to land. Trustees or a trustee may be appointed by any community of persons bound together by custom, religion, kinship or nationality or by any body or association of persons established for any specified purpose, or for any purpose which, in the opinion of the Minister, is for the benefit or welfare of the inhabitants of Zambia or any part thereof. Such trustees or trustee may apply to the Minister for a certificate of registration of the trustees or trustee of such community, body or association of persons as a corporate body.

    This Act makes provision with respect to agreements on the fencing of land and actual fencing. This Act shall apply to such areas as the Minister may, by statutory notice, declare. The Minister shall not apply this Act to any area unless the majority of owners of occupied farms in the area present and voting have expressed themselves in favour of such application at a meeting convened in accordance with this Act.
