Land Tenure Working Paper 19. The present paper is written as part of the overall Voluntary Guidelines consultation and development process and is a contribution to the subsequent preparation of the Gender Technical Guide. It contextualises and defines gender for the Voluntary Guidelines, discusses what governance of tenure means from a gender perspective and identifies and analyses key issues and themes. It then summarises recommendations relevant to gender before drawing some conclusions for the development process of the Voluntary Guidelines.

The Guideline No. 1 of 2013 of the Ministry of Energy and Industry lays down rules and procedures for evaluating the applications submitted for construction permits for energetic, mineral, industrial and other high-risk works, abd establishes the Commission for the evaluation and issuance of such permits. The blue prints of the proposed constructions as approved by the local authorities should be included in the application. In case of incomplete documentation, the applicant has a 30-day period for its completion.

The Guideline provides for areas of the public forestry and pasture fund that may be leased according to the public competition/bidding procedures. The forestry authorities assess the forestry and pasture areas at the beginning of the year and submit the proposed list of leases to the municipality together with a detailed report on their potential use. The leases should comply with the law requirements regarding the allowed activities as well as the long- and short-term management plans.

This Guideline lays down technical criteria for valuating trees in agricultural lands and meadows expropriated or temporarily taken into possession for public interest. It establishes separate procedures for different types of trees such as olives, vineyards and fruit trees.
