These Measures are divided into 8 Chapters: General Provisions (I); Ownership and Right to the Use of Land (II); General Plans for the Utilization of Land (III); Protection of Cultivated Land and Land Reclamation (IV); Land for Construction Purposes (V); Supervision and Inspection (VI); Legal Responsibilities (VII); Supplementary Provisions (VIII).Article 7 provides for lands which shall be under the collective ownership of farmers and herdsmen. The land use rights and contractual management rights of farmers and herdsmen are protected by law, and the term of the land contract and operation period shall remain unchanged for a long time. Users of state owned land and collective land owners and users must apply for registration of land to the land administrative departments of the people's governments at or above the county level, and obtain state-owned land use certificates and collective land ownership certificates, the collective land use permits. The overall land use planning at or above the county level shall be developed by the land administration department and other relevant departments. Township (town) land use overall plan shall be developed by township (town) people's government. Overall land use planning shall be submitted for approval in accordance with the provisions stipulated in Article 16. For cultivated land, a special protection and cultivated land occupation compensation system shall be applied.
