La presente Ley deroga la Ley que tiene por objeto establecer un marco jurídico que permita el ordenamiento y la titulación de los bienes inmuebles cuya propiedad recaiga en instituciones de derecho público, empresas públicas y municipalidades y que estén siendo ocupados por personas físicas en carácter de precaristas.

Decision No. 139 dated 22.2.2012 supplementing Council of Ministers Decision No. 502 dated 13.7.2011 approving the uniform regulation on the control of territory development.

Decision No. 139 of 2012 supplements the Council of Ministers’ Decision No. 502 of 2011 on the uniform regulations regarding the control of the territory development. The supplements add several requirements in the application for construction permits and amend their applicable deadlines.

This Decree provides for the urbanised villages (in annex) according to the Ministry of Housing and Urban Communities. The licensing for the construction of buildings and structures within those villages has to be approved, according to the Agriculture Act, by the general Authority for Urban Planning.

This Regional Law regulates transfer of agricultural land parcels in ownership to gardeners, vegetable growers and subsistence farmers, and to non-commercial associations thereof, out of stock of public and municipal land, except for cases of transfer free of charge envisaged by the national legislation. Buy-out price shall be fixed at 20 percent of cadastre value for agricultural land and 10 percent of cadastre value for urban land.

This Regional Law classifies protected categories of citizens that shall have the right to allotment on condition of ownership of public and municipal land free of charge related to urban land for individual housing construction and agricultural land for subsistence farming.

This Regional Law establishes that land plots for individual housing and suburban construction shall be allotted to citizens in ownership with or without competitive tendering. Citizens that have no right to be allotted land plots without competitive tendering must purchase them exclusively through competitive tendering. Russian nationals that have obtained land parcel free of charge for suburban construction in accordance with this Regional Law shall have no right to allotment of land plot free of charge for individual housing construction.

This Regional Law establishes the modalities of legalization of the rights of ownership to public land plot allotted to a citizen for individual housing and suburban construction or for gardening if the documents of ownership by application of estate-leaver were not legalized during the lifetime. In the aforesaid case the heir shall have the right of allotment free of charge of the plot of land applied for by estate-leaver while alive.

Decreto Nº 872 - Reglamenta parcialmente la Ley Nº 1.537, sobre normas tendientes a facilitar y promover el desarrollo urbano y el acceso a la vivienda.

La presente Resolución aprueba el Reglamento de Inscripciones del Registro de predios, regula los requisitos para la inscripción de los diferentes actos o derechos en el Registro de predios, las formalidades de los documentos que dan mérito a las inscripciones, el contenido de los asientos registrales y los procedimientos previstos en otras normas de carácter registral.
