This publication, Innovative Land and Property Taxation, is derived from a 2009 Conference in Warsaw, Poland. It presents the ways in which land and property taxation policies, legal frameworks, tools and approaches to sustainable urban development have been experimented with around the World. Its key finding is the prominent role that land-based financing and local authorities play at the core of urban development.

Land and Property Tax: a Policy Guide is a companion for government officials and land and property professionals seeking to understand how to establish a viable and vibrant land-based taxation system. Using various examples, alternatives and illustrations around the World, the Guide provides a compelling case for generating local revenue through land and its improvements.

The acquisition of land by foreigners in developing countries has emerged as a key mechanism for foreign direct investment (FDI). FDI is defined by the Organization for Economic Cooperation and Development (OECD) as the category of international investment that reflects the objective of a resident entity in one economy to obtain a lasting interest in an enterprise resident in another economy.

Land acquisitions, either driven by foreign investments or domestic investment needs have continued to polarize opinions. In the recent past, high profile cases involving land governance problems have been thrust into the public domain. These include the case involving the grabbing of a playground belonging to Lang’ata Road Primary School in Nairobi and the tussle over a 134 acre piece of land in Karen. Land ownership and use have been a great source of conflict among communities and even families in Kenya, a situation exacerbated by corruption.

The absence of a clearly defined land use policy in Kenya after years of independence has resulted in a haphazard approach to managing the different land use practices and policy responses. Land use continues to be addressed through many uncoordinated legal and policy frameworks that have done little to unravel the many issues that affect land use management. The Constitution of Kenya 2010, Kenya Vision 2030 and the Sessional Paper No. 3 of 2009 on National Land Policy all call for a clear framework for effectively addressing the challenges related to land use.
