This Decree prohibits the discharge of specified types of waste in discharge premises which from part of a specified category, including various kinds of organic waste from plants or animals. It also makes provision for power of the Competent Authority to attach conditions to the granting of a permit to discharge specified waste. (15 articles completed by 2 Schedules)

Decree to regulate the discharge of solid waste. The text consists of 20 articles divided into 3 Chapters: General provisions (I); Requirements relative to obtaining a permit (II); Further provisions (III). Article 1 contains definitions. Article 2 defines the application sphere of the Regulation. Chapter II concerns the conditions and requirements which the Competent Authority may prescribe in relation with the application for and the granting of permits to discharge solid waste.

The Government decrees to validate the Regulation. Committee of Municipal Services is a central Federal Executive Body entitled to carry out state regulation and inter-departmental coordination as regards municipal services (housing facilities, heat and electricity supply, water supply and sewerage, engineering protection, equipping with services and utilities, urban planning and road-building, waste disposal, municipal bath and laundry services, ritual services for the population, scientific planning and industrial and production support).

Different Divisions of the Development Control Commission shall deal with application for specified types of development permissions. Development permissions that may be applied for include: waste disposal, sewage treatment, and recycling plants, harbour works, and infrastructure and utilities projects.

Part II of this Order makes provision for implementing Council Directive 96/61/EC and for otherwise preventing and controlling pollution. It amends the transitional provisions in relation to waste management licenses in Article 47 of the Waste and Contaminated Land (Northern Ireland) Order 1997 and makes provision about certain expiring disposal licenses. Part III makes provision for implementing Council Directive 96/62 EC and for otherwise preventing and controlling air pollution. Part IV makes new provision with respect to areas of special scientific interest.

These Regulations amend regulation 21 of the principal Regulations. Regulation 21 originally provided, inter alia, for control of groundwater quality. That part of the Regulation is now deleted.

Amends: Waste Management (Landfill) Regulations, 2002 (L.N. No. 168 of 2002). (2002)

These Regulations provide rules for the use of deposit of waste for the filling up of land sites. These Regulations provide additional measures procedures and guidance to rules contained in the Waste Management (Permit and Control) Regulations, 2002, to prevent and reduce as far as possible negative effects on the environment in particular the pollution of surface water, groundwater, and soil from landfilling of waste. Regulation 4 classifies landfills. Regulation 9 concerns the application for a landfill operating permit.

These Regulations provide additional measures procedures and guidance to rules contained in the Waste Management (Permit and Control) Regulations, 2002, on the controlled disposal of Polycholorinated Biphenyls and Polycholorinated Terphenyls, the decontamination or disposal of equipment containing such substances, or the disposal of used substances in order to eliminate them completely.

The conditions and method of use and parcelling out of lands, and building must be determined by urban development plans and by local building regulations. Urban areas may be divided into built-up areas or non-built-up areas. These areas shall be classified, on the basis of their general use and characteristics, into various land use categories.
