La presente Ley contiene el Código Rural, el cual constituye el conjunto ordenado y sistemático de las normas administrativas, reglamentarias, de policía y jurisdiccionales de aplicación en el orden rural. Fija asimismo las normas que rigen el ejercicio, los derechos y obligaciones derivados de la actividad rural en cualquiera de sus especializaciones. El libro I se refiere a las personas rurales.

Las quemas prescriptas, como herramienta de manejo del ecosistema, por los artículos 10 de la Ley Nº 1.354 y 12 a 15 del Decreto Nº 1.925/00, podrán realizarse en el período comprendido entre el 1º de marzo y 31 de agosto del año en curso, previa autorización de la Dirección de Recursos Naturales.

This Law, composed of 17 articles, regulates the use, conservation and protection measures for agricultural land, considered as a common heritage. The Law defines agricultural land characteristics and planning requirements to be applied to both private and public agricultural properties. Moreover, it compels São Paulo’s Secretary of Agriculture to plan and implement the provisions set that shall turn compulsory within the following five years. Finally, the Law establishes the penalties for non compliance with its provisions.

The present Regulation establishes the modalities of the institution and examination of the applications of enterprises, institutions and organizations, and also of citizens regarding concession of the plots of land out of all categories of land irrespectively of the type of ownership except for cases envisaged by the legislation. Concession of land shall be carried out in the form of allotment in accordance with decree of the Government or of the respective organ of executive power. The document consists of 6 sections. Section 1 lays down general provisions.

Involvement of arable land in agriculture is one of the most important tasks of the agricultural institutions that shall contribute to rising up agricultural production. The Government decrees to validate the Regulation on organization of dehkan farms and the Regulation on the formation and concession of special land stock. Regulation on organization of dehkan farms establishes that dehkan farms shall be set up on lands of special land stocks by executive committees of the local Councils of people’s deputies, and also on lands of kolkhozes, sovkhozes and other agricultural enterprises.

Land in the Republic of Tajikistan is exclusive state property, and the state guarantees its efficient use in the interests of the population. One of the main ways of the agricultural development of the country is the improvement of the state of ameliorated land, organization of complete, rational and efficient use of available land and development of new lands. The Regulation consists of 18 Sections. Section 1 is a foreword. Section 2 regards land resources. Section 3 regards arable land. Section 4 regards perennial plants’ land. Section 5 regards hay-making and grazing land.

The following order of the formation and registration of the right of land tenure shall be applied: 1). A citizen shall submit to the district land committee an application for the allotment of a plot of land for setting up a peasant farm. 2). Examination of the application shall include the following documentation: a). map of the plot of land; b). decision on allotment; c). decision of the rural land committee on setting up peasant farm; d). certificate of the rural land committee on land share; e).

The present Law determines legal basis for setting up, functioning and liquidation of agricultural entrepreneurial activities (dehkan farms), regulates their rights and duties, and also relations with other legal and natural persons. The Law consists of 7 Chapters that contain 31 articles. Chapter 1 (arts. 1-6) lays down general provisions. Chapter 2 (arts. 7-11) regards allotment of land to dehkan farms, land ownership, land tenure and water use. Chapter 3 (arts. 12-14) establishes the rights and the duties of dehkan farm and its members. Chapter 4 (arts.

The purpose of land inventory is comparative valuation of it quality and natural production capacity by points under real level of agricultural production. Land inventory is the principal type of inventory of land quality, is essential for subsequent valuation of agricultural land, determination of the amount of property share, carrying out land use planning and stimulation of the rational and efficient land tenure. The Regulation consists of 14 sections. Section 1 Lays down general provisions. Section 2 introduces the basic concepts.

The Government decrees to validate average rates of land tax for provinces, cities, districts and urban settlements that are valid for hayfields, public constructions, forests, areas, channels, irrigations systems and sewerage for non-agricultural purposes, irrigated land, dry-farming land, arable land and perennial plants.

The present Regulation establishes the modalities of forwarding application and legalization of materials for the purpose of transfer of land from one category into another and low-yield land into unproductive land. Reduction of the area of irrigated land, arable land, perennial plants and other high-yielding areas, including transfer of land from one category into another and low-yield land into unproductive land shall not be allowed except for cases of necessity and exclusively in accordance with the Ministerial Decrees.

This Decree, composed of 30 articles, implements the Law No. 6.171 on the use, conservation and protection of agricultural land, envisaged as common heritage. The use and management of agricultural land shall be carried out through land use planning in accordance with the current land conservation agricultural techniques. The Decree defines the functions and powers of the Secreatry for Agriculture, the competent authority for the implementation of the provisions set under this Decree.
