La presente Ley adopta medidas para la prevención del desplazamiento forzado, la atención, protección, consolidación y estabilización socioeconómica de los desplazados internos por la violencia, y crea el Sistema nacional de atención integral a la población desplazada por la violencia.

Article 62 shall be supplemented with the following items: (a) “Item 3. Members of agricultural cooperative shall voluntarily transfer in usufruct free of charge without the right of expropriation for the period of no less than one year; (b) “Item 5. Agricultural cooperative shall use transferred agricultural land in accordance with the legislation and in the interest of landowner”; (c) “Item 7. Agricultural cooperative shall be granted the right of purchase agricultural land from other landowners, including members of the aforesaid cooperative”; and (d) “Item 8.

Item 4 shall be supplemented with a paragraph of the following wording: “This norm shall not be applicable to the calculation of rent for lease of agricultural land”.

El presente Decreto reglamenta la Ley que adopta medidas para la prevención del desplazamiento forzado y la atención, protección, consolidación y estabilización socioeconómica de los desplazados internos por la violencia, en relación a la declaratoria de la inminencia de riesgo de desplazamiento o de desplazamiento forzado en una zona y limitaciones a la enajenación o transferencia a cualquier título de bienes rurales.

Paragraph one of the Article 10 shall acquire a new wording: “Agricultural land lease contract concluded for the period exceeding three years shall be registered at the local land cadastre office”.

Paragraph 6 of the Article 6 shall acquire a new wording: “In case of any transaction leading to transfer/acquisition of land ownership right the person who has transferred the aforesaid right shall be considered the payer of single agricultural tax until the last day of the month in which the contract has been concluded while the person who has acquired the right shall be considered payer of single agricultural tax from the first day of the month following the month in which the contract has been concluded”.

Article 33 shall be supplemented with the following wording: “Lease payment for agricultural land shall be calculated in accordance with quality and location of the plot of land and cadastre valuation thereof”.

This Order establishes the modalities of legalization and registration of purchase and sale of the plots of agricultural land between the citizens of Kyrgyzstan and in case of expropriation of thereof from the persons who cannot own them in accordance with the legislation. Transactions with agricultural land shall be subject to compulsory state registration without notarial certification. In case of purchase and sale of a plot of agricultural land vendor and buyer change the purposeful use thereof on their own initiative.

The Ministerial Decree regards allotment in lease of agricultural land pertaining to the Special Fund of consisting of agricultural land (except for pastures) pertaining to public property. Allotment of the public agricultural land shall be carried out through tender. The winner of tender shall acquire the right to conclude lease contract in accordance with the terms and conditions of tender within ten days from conclusion of tender and legalization of its outcome.

Purchase and sale of the plots of agricultural land shall be carried out by the owners. In case of purchase and sale by the third parties they must be in possession of notarized letter of authorization. Purchase and sale of public agricultural land shall be carried out through auction sale while private agricultural land shall be purchased and sold directly by agreement between vendor and buyer without any authorization. Maximum area of a single plot of agricultural land shall not exceed 50 hectares.

This Ministerial Decree regulates purchase and sale of agricultural land, organization of auction sale thereof, and the modalities of calculation of rent for lease of public agricultural land. Purchase and sale of the plots of agricultural land shall be carried out by the owners. In case of purchase and sale by the third parties they must be in possession of notarized letter of authorization. Agricultural land contaminated by chemicals and radioactive substances to the degree exceeding the established contamination levels shall not be subject to sale.

This Ministerial Decree validates the Regulation on transfer in lease and management of pastures and the form of contract for transfer of the plots of pasture areas. It classifies pastures as: (a) pastures for transhumance; (b) pastures for intensive management; (c) pastures located between transhumance areas and fixed pasture areas; and (d) pastures of the inhabited areas. All pasture areas shall be mapped and shall have boundaries designated afield.
