European Communities (Good Agricultural Practice For Protection of Waters) Regulations 2009 (S.I. No. 101 of 2009).

These Regulations provide rules relative to good agricultural practice to protect waters against pollution from agricultural sources and prescribe measures for these purposes, including: periods when land application of fertilizers is prohibited; limits on the land application of fertilizers; storage requirements for livestock manure; and monitoring of the effectiveness of the measures in terms of agricultural practice and impact on water quality. They also concern minimization and storage of soiled water and ploughing and the use of non-selective herbicides.

These Regulations amend the Common Agricultural Policy Single Payment and Support Schemes (Cross-compliance) (England) Regulations 2005 in paragraph 3 of the Schedule so as to allow the Secretary of State, in exceptional weather conditions, to exempt farmers from requirements relating to waterlogged soil for a reasonable time.

By virtue of this Decision, England, Scotland and Wales are granted a derogation for the purpose of allowing a higher amount of livestock manure than that provided for in the first sentence of the second subparagraph of paragraph 2 of Annex III to Directive 91/676/EEC, subject to the conditions prescribed by these provisions.

This Order establishes additional provisions related to the Farms Act. A farm/land property can be registered as such and notification thereof shall be submitted to the Survey and Cadastre Authorities to ensure proper residency status. When establishing a new farm, or purchasing additional land, a 10-year residence proof is required by the purchaser within 6 months from the date the Survey and Cadastre Authorities have registered the cadastral changes. Provisions also include companies in other EU countries or countries that have signed the Agreement on the European Economic Area (EEA).

The President authorizes experimental allotment on unused land and land of marginally profitable or unprofitable agricultural enterprises to citizens on condition of life-long hereditary possession. The aforesaid land shall be used for agricultural purposes. The dimensions of land area shall be established with the consideration of local conditions but shall not exceed 5 hectares for irrigated areas and 15 hectares for non-irrigated areas.

The present Regulations are made under the Real Property Assessment Act. In particular, the Regulation lays down detailed provisions relating to the enforcement of the afore-mentioned Act in the Province. For the purpose of the present Regulation, “assessment list” means a list of all properties in a municipality and such assessment list shall contain all of the information described in clause b) in relation to those properties and the number of the municipality.

In particular, for property tax purposes, the Taxation and Property Records Division of the Department of Finance, Energy and Municipal Affairs assesses the value of all real property within the Province. Taxing authorities use property assessments to determine the tax rates needed to raise the revenue required to pay for public services. Taxation and Property Records sends property owners a Statement of Account - Property Charges that shows assessed values and the applicable charges.

The present Regulations are made under the Real Property Tax Act. In particular, the Regulation lays down detailed provisions relating to the enforcement of the afore-mentioned Act in the Province. Section 5 deals with special real property tax levied under clause 12(5) of the Act and establishes that it shall be levied at the same rate as the rate levied pursuant to the Act for the taxation year in which the improvements were made. The text consists of 27 sections.
