Fundamental Principles of Legislation of the USSR and the Union Republics on Land, 1990.

Legislation

This Act provides the general framework for principles regulating land relations in the USSR and the Union Republics. Union and autonomous Republics are to promulgate more detailed legislation within this framework. This Act excludes relations regarding mining, forestry, water and the protection of flora, fauna and the atmosphere. The Act is directed towards the creation of conditions for the rational use and protection of land, the regeneration of soil fertility, the preservation and improvement of the natural environment, and the equal development of all forms of economy.

La presente Ley tiene por objeto el fomento, desarrollo y protección integrales del sector agrario. Para la ejecución de la política agraria (cap. IV), mediante el artículo 23, se crea el Instituto Nacional de Desarrollo Agrario (INDA), como entidad de derecho público, con ámbito nacional, personalidad jurídica y patrimonio propio, adscrito al Ministerio de Agricultura y Ganadería. El INDA substituye en sus funciones al Instituto Ecuatoriano de Reforma Agraria (IERAC).

Le Code pastoral définit les règles générales devant régir la pratique de l'élevage traditionnel en République de Guinée. Ce décret porte composition, attributions et modalités de fonctionnement de la commission consultative prévue à l'article 12 du décret nº 76-166 du 27 avril 1976, fixant les modalités de gestion du domaine national. Cette commission est chargée notamment: d'organiser l'espace rural en zones agricoles et zones d'élevage; de définir les modalités d'utilisation des zones mixtes, qui sont insusceptibles d'appropriation privée; d'assurer le respect des délimitations agro-pastorales et de règler les litiges agro-pastoraux.

El comisariado ejidal es el órgano encargado de la ejecución de los acuerdos de la asamblea, así como de la representación y gestión administrativa del ejido (art. 32). Como órgano de participación de la comunidad podrá constituirse en cada ejido una junta de pobladores, integrada por los ejidatarios y avecindados del núcleo de población, la que podrá hacer propuestas sobre cuestiones relacionadas con el poblado, sus servicios públicos y los trabajos comunitarios del asentamiento humano (art. 41).

La presente Ley regula las características, funcionamiento y competencias de los Tribunales Agrarios, definidos como órganos federales dotados de plena jurisdicción y autonomía para dictar sus fallos, a los que corresponde la administración de la justicia agraria en todo el territorio nacional (art. 1º). Los tribunales agrarios se dividen en dos: Tribunal Superior Agrario y los Tribunales unitarios agrarios (art. 2º).

This Act, consisting of 41 sections and completed by two Schedules, provides also for the management of the land vested in Aboriginal Corporations.The sections of this Act are divided into 7 Parts: Preliminary (I); Vesting of Condah Land and Framlingham Forest (II); Management of Condah land (III); Management of Framlingham Forest (IV); Mining (V); Trust Funds (VI); Miscellaneous (VII).On the commencement of this Act, Framlingham Forest, shall be vested in the Kirrae Whurrong Aboriginal Corporation.

The Act provides for powers of land surveyors to carry out land survey of boundaries of estates and for procedures of such survey, the review of surveys and the inclusion of surveys in survey plans. Notice of land survey shall be given 7 days prior to survey and shall be in the form as set out in the First Schedule. A warrant of land survey shall be issued in a prescribed form by a judge if survey is carried out to establish boundaries of adjoining lands in order to resolve a land dispute (sect. 6).

An Act to make provision for farm business tenancies which begin after 1 September 1995. Section 4 excludes in part the Agricultural Holding Act, 1986 to tenancies covered by the present Act. Sections 5 to 7 provide rules for the termination of tenancies. Tenancies continuing for more than two years shall afterwards continue from year to year unless terminated by notice (sect. 5). Section 8 recognizes the right of a tenant to remove buildings and fixtures.

This Act provides rules relative to the survey of land. consists of 49 sections which are divided into 9 Parts: Preliminary (I); Administration (II); Recognition and Duties of Land Surveyors (III); Original Surveys and Re-surveys (IV); Division Surveys (V); Townships (VI); Beacons and Boundaries (VII); General Plans and Diagrams (VIII); Miscellaneous (IX).At Harare a Surveyor-General's Office is established (sect. 7). A Survey Regulations Board is established under section 8. The Board may make Regulations, with approval of the Minister, prescribing matters specified in section 9.
