The Regional Acts and Regulations mentioned in the Annex attached to this Act are repealed.

Cette loi a pour objet de modifier et de compléter les dispositions de la loi nº 90-29 du 1er décembre 1990 relative à l’aménagement et l’urbanisme, et notamment, entre autres, les dispositions de l'article 4 qui fixe les conditions pour que les parcelles soient constructibles; de l'article 7 en base auxquelles toute construction à usage d'habitation doit justifier d'un point d'alimentation en eau potable.

The present Law establishes the conditions for the use of land of defence. Plots of land destined for the accommodation and permanent functioning of military units, institutions, military educational institutions, enterprises and organizations of the Ukrainian armed forces and other military formations set up in accordance with the Ukrainian legislation.

This Chapter requires the Department of Agriculture, Land and Fisheries to consider the impact on antiquities and traditional culture of Government action that might affect land or State waters. The Department shall report its findings to the Governor, the Legislature, and components of Government involved in the proposed action.

This Chapter specifies rules relative to the writing, transfer, foreclosure, etc. of a deed of trust and defines legal consequences and proceedings in relation with the creation or foreclosure of a deed of trust. A transfer in trust of an estate in real property may occur to secure the performance of an obligation or the payment of a debt. A transfer does not entitle the trustee or beneficiary to the possession of the property, except as provided in this Chapter.

This Chapter concerns the designation by the Governor of Kosrae of homestead areas and the establishment of such areas and specifies requisites for eligibility and conditions for the entry upon and occupancy of public land in homesteading areas. Lands suitable agricultural or grazing purposes or for the establishment of community sites, and which are not required for government use or reserved for other purposes by any other provision of law, may be designated by the Governor for homesteading purposes.

This Chapter concerns the designation of homestead areas and the establishment of such areas and specifies requisites for eligibility and conditions for the entry upon and occupancy of public land in homesteading areas. Lands suitable for agricultural or grazing purposes or for the establishment of community sites, and which are not required for government use or reserved for other purposes by any other provision of law, may be designated by the High Commissioner for homesteading purposes.

This Law defines the local government structures which shall be in charge of the protection and administration of the land. The Section on Land Administration and Protection is established at the regional level, as a delegation of the Council of Ministers (art. 3). Its functions are listed in article 12. Articles 14 to 17 lay down penalties to be applied in case of violation of measures related to physical damage, reduction of fertility and degradation.

The Act, which is composed of 16 Paragraphs, establishes tasks of organs and organizational units concerning rural areas development support financed by the European Agricultural Guidance and Guarantee Fund, and in particular: receiving of structural pension; support agricultural activities on areas of disadvantageous conditions of farming; support agricultural ventures and improvement of the state of livestock; afforesting agricultural land; adaptation of farms to European Union standards; support groups of agricultural producers; technical support to organs and organizational units dealin

The law regulates legal relationships between state bodies, natural persons and legal entities in the sphere of amelioration (art. 1). This law covers the following spheres: a) land reclamation; b) amelioration activities; c) flood (and other disasters) control measures on agricultural lands; d) amelioration associations (art. 3).

The present Regional Law regulates relations in the sphere of turnover of the plots of agricultural land and shares in common property on the plots of agricultural land. Minimum area of the newly formed parcels of agricultural land except for artificially irrigated and (or) drained land shall be of 0, 5 hectares (art. 1). The terms and conditions of privatization of agricultural land shall be established by the regional legislation (art. 2).

This Act lays down basic provisions on land tenure, both rural and urban. All land in Viet Nam is the property of the State, but individual and corporate users, both domestic and foreign, can obtain from the State usufructuary rights under lease-type contractual arrangements (art. 1). Long-term leases, in particular, of cropland are made for twenty years for annual crops and aquaculture, and for fifty years for perennial crops, both terms being renewable on expiry (art. 20).
