El comisariado ejidal es el órgano encargado de la ejecución de los acuerdos de la asamblea, así como de la representación y gestión administrativa del ejido (art. 32). Como órgano de participación de la comunidad podrá constituirse en cada ejido una junta de pobladores, integrada por los ejidatarios y avecindados del núcleo de población, la que podrá hacer propuestas sobre cuestiones relacionadas con el poblado, sus servicios públicos y los trabajos comunitarios del asentamiento humano (art. 41).

This Decree-Law seeks to reprivatize land expropriated in the areas subject to past agrarian reform and assigned to small farmers or cooperatives for cropping. With due regard to the agricultural land redistribution policy, the Decree-Law grants the same categories of beneficiaries full ownership of that land provided that they have farmed it effectively and rationally for a period of not less than 7 years from the date it was allocated to them.

With due regard to the crop farm redistribution policy, this Decree-Law defines the rules governing the allocation of expropriated or nationalized land which, with few exceptions, shall not be managed directly by the State or by public entities. It shall, in general, be allocated for cropping to private individuals or bodies corporate with sufficient professional competence. These are listed, in order of priority, as young farmers (between 18 and 40 years), small farmers (without a steady salary), and groups of rural workers (cooperatives, for instance).

The Act establishes that the right to administer the soil, water and air is vested in the State. The State, therefore, has the authority to: (a) regulate the allotment, use, supply and maintenance of soil, water and air; (b) regulate the legal relations between persons and soil, water and air; (c) regulate the legal relations between persons and legal acts concerning soil, water and air. The exploitation of these resources both by individuals or corporate bodies is to be performed within the objective of the national interest and by guaranteeing the protection of economically-weak groups.

The present Act aims at amending and consolidating current legislation relevant to the acquisition of land. The Government may acquire any land at any place for any public purpose, if it so deems necessary, according to the procedures set out by this Act.

Guthi Corporation Act 1976.

This Act concerns the establishment of the Guthi Corporation as an autonomous and corporate body. For the management of the corporation a Board of Directors shall be formed according to the provisions of Section 9. Guthi means "a Guthi endowed by any philanthropist with religious or philanthropic motives through relinquishment of title to his movable or immovable property or any other income-yielding property or funds" for the performance of religious functions, or construction and maintenance of temples, wells, ponds, libraries, hospitals, etc.

Pasture Lands Nationalization Act, 1974.

The present Act regulates the nationalization of pasture lands. Nonetheless, the registered owner may retain possession of pasture land within the ceiling prescribed by the legislation in force, and the government may grant exemption for the purpose of horticulture, animal husbandry, herbal farming and tea plantation. The Act provides also for the payment to registered owners of a compensation to be determined on the recommendation of an ad hoc committee. The protection of and the pasturage on such lands is entrusted to the local Village Panchayat.

Forest Areas Lands Act, 1971.

The present Act makes arrangements relating to lands in Forest Areas. Such lands shall be sold by the appropriate authority to peasants who have "settled down there and who have been cultivating the lands for at least one year past..." (art. 4(1)). Land left over after sale and distribution as described above shall be sold or distributed in the prescribed manner. Further provisions concern the registration of lands, the modalities for the payment of the price of the land by the allottee and enforcement measures.

The present Rules consist of 46 articles divided into the following Chapters: Preliminary (I); Tenancy Rights, Records of Tenancy Rights, and Ceilings on Tenancy Holdings (II); Ceilings on Land Holdings, Compensation and Sale and Reallotment (III); Compulsory Savings and Credit Arrangements (IV); Miscellaneous (V). As far as tenancy is concerned, chapter 2 establishes that the District Land Reform Officer designated by the Government may appoint several land reform teams "for the purpose of collecting records of owner-cultivators as well as of tenants cultivating lands owned by others".

Decree of the Prime Minister relating to the transformation of State land use right and ownership on houses, vehicles and essential household equipment into Government personnel ownership and use right.

The present Decree concerns the transfer of State ownership and right of use on land, houses, vehicles and household equipment to the Government cadres and personnel. Certain land use rights, houses, vehicles and household equipment that had already been used by cadres and personnel shall be transformed into absolute ownership and right of use, upon payment on sale either in full or in long-term instalments. State houses or lands which are not covered by said procedure might be rented to cadres and personnel at a rate to be determined by the Government.
