The present Law defines the legal basis for organization and activity of Dehkan farms in the Republic of Tajikistan. The Dehkan farm is an independent managing subject carrying out its activities being not a legal person and based on individual business of a person, or members of the one family and other citizens jointly producing agricultural commodities on the basis of the plot of land and other properties being in its possession. The document consists of 34 Articles. Article 1 establishes the purpose of the present Law. Article 2 regards legislation on Dehkan farm.

Article 1 (1) shall be amended to add the following wording: “Regional Legislative Assembly shall establish the modalities of calculation of land charges pertaining to regional property, and land charges for public land with undelimited property, in case of sale of land plots to lease holder upon expiry of three-year period since the moment of conclusion of lease contract on condition of purposeful land tenure”.

Law amending and supplementing a number of articles of the Land Law. Amendments of the principal Law concern ownership of land by the people of Vietnam and management of land by the State (art. 1), protection of land use rights by the State (art. 3), assignment of land by the State to organizations, households and individuals (art. 4), and exemption from payment of land use levy (art. 22). Three new articles are added to the Law after article 22: they further specify when payment of land use levy is due. Four new articles are added to the Law after article 78.

The Decree-Law is set in bold-type and the Decree is set in normal characters. In order to safeguard real estate rights and statutory interests, the register of real estate contains data on all immovable property in the country, on rights in connection thereto and other relevant information. Certain rights come into being through registration.

Article 2 shall be amended to add the following wording: “Regional Government shall be responsible for validation of the contents and the attached documentation of the application for transfer to other category of agricultural land, except for land pertaining to the ownership of the Russian Federation”.

By virtue of this Act the Region of Marche recognizes the role of farmers as protectors of biodiversity and the environment. The Act promotes the protection of local traditions in the field of agriculture and aims to prevent the abandonment of agricultural lands and activities.

Article 1 shall be amended to add the following wording: “This Regional Law regulates certain relations in the sphere of transactions of plots and shares of agricultural land within plenary powers of the regional administration”.

Article 18 shall be amended to add the following wording: “Normative monetary valuation of land shall be performed as follows: (a) urban land irrespectively of the purposeful use thereof non less than once in 5-7 years; (b) agricultural land located outside inhabited areas non less than once in 5-7 years, while non-agricultural land – non less than once in 7-10 years”.

This Decree of the Department of Agriculture is based on Chapter 9 of the Land Code. It empowers the County Councils to appoint inspectors for the surveying and inspection of agricultural tenancies. It specifies criteria for appointment and grants powers to the county councils to repeal the appointment if an inspector is not suited for the work.
