La presente Ley de protección a los ocupantes de zonas clasificadas como especiales, suspende el desalojo de personas, demolición de obras, suspensión de actividades y proyectos en la zona marítimo-terrestre, zona fronteriza y patrimonio natural del Estado. Tal disposición no excluye dictar las medidas cautelares judiciales o administrativas, ni la ejecución de resoluciones judiciales o administrativas en firme, en ambos casos cuando se determine la comisión de daño ambiental o peligro o amenaza de daño al medio ambiente.

This Presidential Decree, consisting of 2 Chapters, regulates the expropriation regime of public coastal lands designated to infrastructures and support equipments for beach facilities on the entire coastal area up to the maritime zone (excluding harbours and military areas) and the land protection area with a maximum width of 500 metres, transferring the competencies to the private domain of the respective Provincial Governments.

These Regulations amend the Foreshore Act 1933 for the purpose of giving effect to Council Directive No. 2011/92/EU. They amend section 13A with respect to environmental impact assessment: The appropriate Minister shall, as part of his or her consideration of a relevant application, in accordance with paragraph ensure that, before a decision on the application is given, projects likely to have significant effects on the environment by virtue, inter alia, of their nature, size or location are made subject to an environmental impact assessment.

These Regulations designate a coastal area as a Special Protection Area in accordance with Article 4 of Directive 2009/147/EC of the European Parliament and of the Council on the Conservation of Wild Birds. The purpose is to ensure protection from disturbance, capture and damage to nests and eggs under Article 5 of the Directive for all species of birds, not just the birds listed on Schedule 3 (with the exception of those birds covered under Articles 7 for hunting and 9, where derogations are listed).

These Regulations amend the Development and Planning Regulations (2011 Revision) in regulation 2 (interpretations), regulation 3 (applications for building permission), regulation 8 (general requirements re parking, height, setbacks, waterfront property, etc and grant of planning permission to carry out development that does not comply with all or any of the specified) and Schedule 1 (fees). They also add a new Third Schedule setting out a new commercial zone.

This Act provides principally for the control on the development of land and the planning of development in the Cayman Islands. For this and other purposes, it establishes the Central Planning Authority and the Development Control Board. The Act also concerns acquisition and disposal of land for planning purposes. The Board or the Authority, as the case may be, shall assess and grant permission for proposed development.

These Regulations prescribe the fees payable, and the methods and rates by which fees are to be assessed, for the consideration and processing of applications made under sections 35, 38(3), 39(1), 40(1), 43, 43(5) and 44(3) of the Act. The fees relate to: applications for interests in reclaimed land; applications to vary a determination that relates to whether an interest in reclaimed land is to be granted and any terms and conditions relating to the interest or grant; the vesting of interests in reclaimed land; applications for renewal of interests less than freehold; etc.

The present Regulations are made under section 13 of the Beaches Act. The Regulations lay down provisions relating to the safeguard of beaches. Section 4 establishes that the the Minister may enter into a management agreement with the owner or occupier of land adjacent to a beach. Section 7 lists activities which are prohibited on a beach, such as remove mineral, fossil, sand, gravel or other object of natural interest. The text consists of 15 sections.

The purpose of the present Act is to: a) provide for the protection of beaches and associated dune systems as significant and sensitive environmental and recreational resources; b) provide for the regulation and enforcement of the full range of land-use activities on beaches, including aggregate removal, so as to leave them unimpaired for the benefit and enjoyment of future generations; c) control recreational and other uses of beaches that may cause undesirable impacts on beach and associated dune systems.

These Regulations declare the land between the seaward edge of the bold line shown on the plans in the Schedule and the mean high water mark on the seashore at spring tides to constitute part of the coast for the purposes of the Coast Protection Act 1972.
