This Notice of the Minister of Environmental Affairs and Tourism, made under section 21 of the Environment Conservation Act, 1989, identifies in Schedule 1 activities that may have a detrimental effect on the environment in respect of areas included in Schedule 2, which form the Outeniqua Sensitive Coastal Area. Those activities include: disturbance of vegetation, dredging, dune stabilisation and earthworks.

Regulations under section 26 of the Environment Conservation Act, 1989 regarding identified activities concerning the Pennington Sensitive Coastal Area and Umtamvuna Sensitive Coastal Area (GN. R. 1531 of 1998).

This Act requires owners to contribute to (jackal-proof) fencing of land by owners of land in areas of jurisdiction of divisional councils on designated on proposal of such councils. The Act also specifies duties and rights regarding fencing in areas where there is no requirement of contribution and, especiallly with regard to neighbouring properties (also if there insist usufructuary rights and servitudes on that such property). The Act also defines certain offences in respect of fenced land and fences.

Regional Law No. 75-OZ “On classification of land parcels as urban land, declassification of urban land parcels and establishment or modification of authorized land tenure”.

This Regional Law establishes that after the conclusion of local government on utility of classification of land parcels as urban land, declassification of urban land parcels and establishment or modification of authorized land tenure the Regional Government shall make decisions on classification or declassification of urban land.

This Decree provides for the content of the land use register which is a computerized data base. It consists of a land use sheet and a collection of documents. Part I of the land use sheet contains data regarding the land user, Part II contains information by plots. Articles 6-16/A lays down the rules of registration, while Articles 17-19/B provides for supplying of data from the register.

This Regional Law establishes legal grounds for land reclamation activity with the consideration of natural and climatic conditions, and also rights and duties of natural and legal persons ensuring efficient tenure and protection of reclaimed land. The scope of land reclamation shall be to ensure improvement of soil fertility and creation of condition for involvement agricultural production of unused and low-productive land. Land reclamation shall be classified as follows: (a) hydrotechnical amelioration; (b) agro-forestry; (c) land clearing; and (d) chemical amelioration.

This Regional Law regulates land relations concerning land-use planning, urban land zoning and land tenure of public land. It establishes that land tenure shall be performed exclusively in accordance with purposeful use of land. Land classification by categories, including classification of public and municipal land as agricultural land, transfer of land from one category to another shall be carried out by the supreme regional executive body.
